| Abstract | استقر الوضع على ان تتمتع البعثات الدبلوماسية بحصانات وامتيازات وتسهيلات تتصل بأعمال البعثة الدبلوماسية، ومن ضمن هذه التسهيلات هي حرية البعثة في الاتصال ولها في سبيل ذلك استخدام كافة وسائل الاتصال المتاحة ومن بين هذه الوسائل الحقائب والرسل الدبلوماسية. ومن منطلق دراستنا هذه قد تلجا الدول لنقل مراسلاتها عبر استخدام الحقيبة الدبلوماسية فمن الواجب حماية المراسلات الصادرة من البعثة الدبلوماسية والواردة اليها من الاطلاع عليها وكشف محتوياتها السرية، لذلك تم إضفاء حرمة خاصة على هذه المراسلات، وقد يقوم بنقل هذه الحقيبة الدبلوماسية موظف يسمى بالرسول الدبلوماسي تتمثل وظيفته بحمل الحقيبة الدبلوماسية وتسليمها شخصيا للجهة المرسل اليها ويتمتع بحصانات وامتيازات خاصة مستمدة من وظيفته كحامل للحقيبة الدبلوماسية. وتعد الحصانات والامتيازات الممنوحة للحقيبة الدبلوماسية من المبادئ الراسخة في القانون الدولي وذلك بهدف ضمان حرية الاتصالات الدولية، ولكن لوحظ في الآونة الأخيرة سوء استخدام الحقيبة الدبلوماسية من خلال ارتكاب جرائم تمس امن الدولة المستقبلة لها او دولة العبور وتم التطرق لعدة امثلة لسوء استغلال الحقيبة الدبلوماسية من خلال هذه الدراسة، وفي هذا الخصوص يجب التوفيق بين اعتبارين هما: احترام حصانات الحقيبة الدبلوماسية وعدم انتهاكها، وبين مصلحة الدولة المستقبلة لها او دولة العبور بعدم المساس بأمنها القومي ونظامها الداخلي ومبدأ سيادة الدولة وهو ما تم التطرق اليه من خلال الفصل الثاني في هذه الدراسة. |

| Alternative Abstract | The situation has stabilized, with diplomatic missions enjoying immunities, privileges and facilities related to the work of the diplomatic mission, including the freedom of communication of the mission and the use of all available means of communication, including diplomatic bags and messengers. As part of our study, states may seek to transfer their correspondence through the use of the diplomatic bag. It is necessary to protect correspondence from the diplomatic mission, to access it, and to reveal its confidential contents, so that such correspondence has been privately impassable. The Diplomatic bag maybe transferred by an employee called the Diplomatic Messenger whose job is to carry the diplomatic bag and hand it over in person to the person whom it was sent to and to enjoy special immunities and privileges derived from his job as a holder of the diplomatic bag. The immunities and privileges granted to the diplomatic bag are a well-established principle in international law with the aim of ensuring the freedom of international communications, but the misuse of the diplomatic bag has recently been noted by committing crimes affecting the securityof the receiving state or transit state. Many incidents of the misuse of the diplomatic bag has been referred to in this study. In this regard, two considerations must be reconciled: respect for the immunities of the diplomatic bag and not violating it, and the interest of the receiving state or the transit state without compromising its national security, its internal system and the principle of State sovereignty, which was discussed through the second chapter of this study. |
