| Abstract | قد يكون المستخدم لمواقع التواصل الاجتماعي عرضة للمسؤولية المدنية عند استخدام صفحته الشخصية التي أنشأها وذلك عن دوره في نشر الإعلانات التجارية المضللة التي تحتوي على بيانات كاذبة أو دعاية خادعة، وتتسبب في إلحاق الضرر للمستهلكين والآخرين ، أو عن دوره عند التفاعل مع الإعلانات التي يعرضها الآخرون، إما بمشاركة هذه الإعلانات أو بكتابة تعليق عليها أو حتى بإبداء الإعجاب بها أو ذمها ، وهذه المسؤولية المدنية قد تكون مسؤولية عقدية ؛ ناتجة عن إخلال أي من المتعاقدين بأحد شروط التعاقد أو لتعرض إرادة المستهلك لأحد العيوب كالغلط أو التدليس؛ فيرتب بذلك قابلية العقد للإبطال لصالح المستهلك ، أو قد تكون المسؤولية تقصيرية ؛ وذلك في حال قيام المستخدم بعمل غير مشروع، كارتكابه خطأ ما فيتسبب في الضرر لشخص ما المستهلك وآخرين، مع توافر رابطة السببية بين هذا الخطأ والضرر المترتب عليه . إن موضوع الدراسة يتعرض لبيان المسؤولية المدنية لمستخدمي مواقع التواصل عن دورهم في الإعلانات المضللة، والتي تتحدد وفقًا للخاصية التي استخدمها ، ووفقا لحالة الاستخدام المواقع التواصل الاجتماعي والدور الذي يقوم به المستخدم، وذلك في ضوء التشريعات القطرية كقانون حماية المستهلك وقانون الاتصالات وقانون المعاملات الإلكترونية والتجارية والتشريعات الأخرى ذات الصلة مقارنة بالتشريعات الأمريكية ، كقوانين حماية المستهلك المقررة حسب كل ولاية ، وقانون لجنة التجارة الفيدرالية ، وقانون لا نهام ، إضافة للسوابق القضائية كمصدر أساسي في النظام التشريعي الأمريكي، وننتهي في الخاتمة إلى عدة نتائج من أبرزها هو بيان الحاجة إلى إصدار تشريع خاص ينظم نشاط الإعلانات على مواقع الإنترنت ومواقع التواصل الاجتماعي والتطبيقات الذكية، لبيان مسؤوليات كل الأطراف ذات العلاقة بهذا النشاط والاشتراطات والضوابط الحاكمة له وفي النهاية نوصي ببعض الحلول المقترحة. |

| Alternative Abstract | Social media user may be subject to civil liability for using the created personal page for his role in publishing misleading commercial advertisements that contain false data or deceptive advertising and cause harm to consumers and others. Responsibility may also arise from user’s role in interacting with advertisements displayed by others, either by sharing these advertisements, commenting thereon, or even by liking or criticizing the same. This civil liability may be a contractual responsibility resulting from breaching any term of contract by either of contracting parties or from exposing consumer’s will to a defect such as error or fraud, leading contract to be voidable in favor of the consumer; or it may be a tort responsibility if user performs an illegal act such as committing a mistake and causes harm to any person (consumer and others), with a causal link between this error and the damage that resulted from it. The subject of this study addresses civil liability of social media users for their role in misleading advertisements, which is determined according to the used feature and according to status of using social media sites and the role played by the user, in the light of Qatari legislation, such as Consumer Protection Act, Telecommunications Act, and Electronic & Commercial Transactions Act, and other relevant legislations, compared with American legislations, such as Consumer Protection Act determined for each state, Federal Trade Commission Act, and Lanham Act, in addition to judicial precedents as a primary source in the American legislative system. In conclusion, we conclude several results, the most important of which is a demonstration of the need to issue a special legislation that regulates the activity of advertising on websites, social media, and smart applications, to clarify the responsibilities and liabilities of all relevant parties, further to requirements and controls governing the same, and recommendations for some proposed solutions |
