Abstract	تتناول هذه الدراسة بالتحليل النقدي المقارن النظام القانوني للأحزاب السياسية في الأردن، وذلك من خلال الوقوف على النصوص القانونية الناظمة للحق في تأسيس الأحزاب السياسية، كما وردت في قانون الأحزاب السياسية الأردني الجديد رقم (39 (لسنة 2015 ،والذي حل محل القانون القديم لسنة 2012 .حيث تم التركيز في هذه الدراسة على أهم الأحكام القانونية الخاصة بتعريف الحزب السياسي وشروط تأسيسه، والإجراءات القانونية الخاصة بتأسيس الأحزاب السياسية في القانون الأردني الجديد لسنة 2015 ،والتي سعى من خلالها المشرع القانوني إلى تكريس فكرة استقلالية الأحزاب السياسية عن السلطة التنفيذية وذلك من خلال تبعيتها إلى لجنة خاصة تسمى «لجنة شؤون الأحزاب السياسية» فيما يخص الرقابة على إجراءات تسجيل الحزب وإصدار القرار المناسب حول طلب تأسيسه. كما تتناول هذه الدراسة الأحكام القانونية الخاصة بتمويل الأحزاب السياسية في الأردن، من خلال وضع مجموعة من القيود الموضوعية على حق الحزب السياسي في تلقي التبرعات والهبات النقدية من جهات وطنية وأخرى أجنبية. كما تعالج هذه الدراسة النصوص القانونية الناظمة لحل الأحزاب السياسية في القانون الأردني الجديد، والتي حاول من خلالها المشرع القانوني الحد من الوصاية الحكومية على مصير الأحزاب السياسية، وذلك بإسناد الحق في حلها إلى القضاء ليكون صاحب اليد العليا في تقرير بقاء الحزب السياسي من عدمه. وستتم مقارنة هذه الأحكام السابقة في قانون الأحزاب السياسية الأردني الجديد، مع مجموعة من القوانين العربية المقارنة للوقوف على نقاط الضعف والقوة في القانون الأردني، ومحاولة الاستفادة من تجارب الدول العربية الأخرى في مجال تكريس الحق الدستوري للأفراد في تأسيس الأحزاب السياسية والانضمام إليها

Alternative Abstract	This study is a critical and comparative analysis of the legal system for political parties in Jordan. It covers the provisions relating to the right to establish political parties in the new Jordanian Political Parties Law No. (39) of 2015, which replaced the old law of 2012. The study focuses on the rules in the 2015 law defining a political party and the legal procedures for establishing one. The rules were designed to promote the principle of independence of political parties. For this purpose, a Committee for the Affairs of Political Parties was set up to decide on the registration of political parties. The study also addresses the rules relating to the funding of political parties in Jordan, which impose objective restrictions on the right of political parties to receive gifts and donations from both national and foreign donors. This study also touches on the rules governing the resolutions of political parties, which were aimed at limiting legislative power over the fate of political parties in favour of giving the judiciary the upper hand to decide on the resolutions of political parties. The provisions in the Jordanian law of 2015 will be compared with their counterparts in other Arab laws in order to assess the strengths and weaknesses in the Jordanian law, and to try to benefit from the experience of other Arab countries in the field of preserving the constitutional right of establishing political parties.
