| Abstract | وقعت كل من مصر والسودان وإثيوبيا في 23/3/2015م وثيقة سميت "اتفاق إعلان المبادئ حول سد النهضة الإثيوبي العظيم"، ولقد أثارت هذه الوثيقة جدلا قانونيا واسعا في تحديد مفهومها، وطبيعتها الملزمة في إطار كل من القانونين الدولي والداخلي. كما أثارت هذه الوثيقة مسألة دستورية - على جانب كبير من الأهمية - تتمثل في إمكانية فرض الرقابة الدستورية - بوسيلة الاستفتاء الشعبي - على مثل هذا الاتفاق في ضوء نصوص الدستور المصري الحالي 2014م. وهذه الرقابة ستكون عديمة الجدوى؛ إذا لم يتم تحديد مزايا هذا الاتفاق، وعيوبه بكل دقة، أمام جموع الشعب المصري، قبل عرض هذا الاتفاق عليه في استفتاء شعبي؛ ليوافق عليه، أو يرفضه. وتحقيقا للهدف من هذه الدراسة؛ فقد قسمها الباحث إلى ثلاثة مباحث؛ خصص الأول فيها لتحديد مفهوم "اتفاق إعلان المبادئ"، و"الاستفتاء الشعبي"، والثاني للحديث عن الطبيعة الملزمة لهذا الاتفاق في القانونين الدولي والداخلي، والثالث للحديث عن عرض مزايا هذا الاتفاق وعيوبه؛ تمهيدًا لعرضه في استفتاء شعبي للموافقة عليه، أو رفضه. وأتبع الباحث ذلك بقائمة بأهم نتائج الدراسة وتوصياتها، وفي النهاية بقائمة بالمراجع العربية والأجنبية. |

| Alternative Abstract | In 23/03/2015, Egypt, Sudan and Ethiopia signed a document titled “Agreement on Declaration of Principles on the Grand Ethiopian Renaissance Dam Project (GERDP)”. This Agreement caused a lot of miss understanding between jurists about its definition and its binding nature in international law and internal law. It also raised a great constitutional issue about a Referendum in current Egyptian constitution 2014. These constitution control methods will be useless if we do not identify advantages and disadvantages of this Agreement strictly, before the Egyptian people approved this Agreement or reject it. To achieve the goal of this research, I divided it to three sections. In the first one I talked about the definition of "Declaration of Principles on the Grand Ethiopian Renaissance Dam Project (GERDP)" and "Referendum", in the second one I talked about the binding nature of this Agreement in the international law and internal law, and in the third one I talked about the advantages and disadvantages of this Agreement. I also put a list of the most important results and recommendations as well as a list of Arab and foreign references. |
