مراتب الواجب وتزاحمها: دراسة تأصيلية تطبيقية

| Abstract | الواجبات مصالح شرعية، والأصل في المصالح جلبها جميعاً أو تكثيرها، إلا أن يتعذر ذلك، وقد يتزاحم لدى المكلف واجبان فأكثر، ولا يمكنه الإتيان بجميع هذه الواجبات والإقدام عليها، فماذا يفعل في هذه الحالة؟ هذا السؤال يشكل إشكالية البحث، وتفرع عنها أسئلة، ومنها: هل ثمة تفاوت بين مراتب الواجب؟ وكيف عالج العلماء مسألة تزاحم الواجبات قديما وحديثاً؟ وهناك عديد من الدراسات السابقة التي بحثت موضوع فقه الأولويات وفقه الموازنات وهذا النوع من الفقه يقترب من الموضوع قيد الدارسة بشكل عام، ولكنه لا يبحثه على وجه التفصيل والتحليل والتمثيل، وتناول تلك الدراسات ت مسألة تزاحم الواجبات بهذه الصورة العامة، او عبر إشارات سريعة خاطفة لا تق دم إجابات وافية وكافية للإشكالية التي تحاول هذه الدارسة أن تقدم لها إجابتها، استدعى فتح هذا الملف العلمي بالدراسة والبحث، واعتمدت الدراسة المنهج، التحليلي: من خلال دراسة النصوص والاجتهادات والفتاوى المتعلقة بالدراسة، ومنهج الاستقرائي: من خلال البحث في النصوص والشواهد والفروع الفقهية، واستنباط القواعد منها. وخلصت الدراسة إلى نتائج، ومنها: أن مراتب الواجبات متفاوتة، وهذا التفاوت يلزم المكلف بتقديم الواجب الأعلى والأقوى والأولى على ما دونه أثناء التزاحم والتدافع. |

| Alternative Abstract | Duties are legitimate interests, and the principle in interests is to do them all or to do extra more, unless this is not possible. The Muslim of responsible age may have more than one Islamic duty to perform, while he mayn’t be able to perform them all. What can he do in this situation? This is the question of our research, along with some sub-questions, including: is there a difference between the degrees of duty? How did the scholars tackle the issue of overcrowding duties, past and present? There were many previous studies that discussed the subject of the jurisprudence of priorities. This type of jurisprudence relates to our study question, but it does not discuss it in detail, analysis and representation. While theses studied didn’t discuss the issue of the accumulation of duties thoroughly, and they didn't provide adequate and sufficient answers to the question that this study is trying to answer: which led to the necessity of opening this scientific file with further study and research. The study adopted the analytical approach: through the study of the Islamic texts, independent reasoning, and fatwas related to the study, and the inductive approach: by researching the Islamic texts, evidence and the branches of Jurisprudence, and drawing rules from them. The study concluded the results, including: that the degrees of duties are different, and this disparity obligates the Muslim of responsible age to prioritize the highest, most important duty to what is below it whenever there's an accumulation of duties. |
