| Abstract | تُثير الأحكام القانونية الخاصة بتصرفات المريض "مرض الموت" في القانون المدني الأردني والقطري العديد من التساؤلات والتحديات القانونية والواقعية التي ينبغي التعامل معها. بل إن فكرة "مرض الموت" تُثير من حيث المبدأ تحدياً قانونياً يجب التعامل معه على درجة عالية من الحساسية لما للموضوع من اتصالٍ وثيق بالحق في الشخصية القانونية والأهلية، وهي من الحقوق الأساسية للإنسان، ومن المسائل التي تتعلق أحكامها بالنظام العام؛ وعليه فأن أي تدخل تشريعي في هذه المسألة ينبغي أن يلحظ هذه الحساسية ويراعيها؛ بأن يكون تدخلاً منضبطاً وفي أضيق الحدود، وبغير ذلك سيأتي التدخل مستهجناً ومحل انتقاد. لهذا كان لزاماً بحث الأحكام الخاصة بتصرفات المريض "مرض الموت" وتقييمها، بهدف اقتراح مقاربات جديدة للتعامل مع حالة المريض "مرض الموت". |

| Alternative Abstract | Legal rules related to legal dispositions during Terminal Disease period in the Jordanian Civil Law and the Civil Law of the State of Qatar present considerable legal questions and challenges that must be dealt with. The mere idea of Terminal Disease presents a very sensitive legal challenge, since it approaches the notion of legal personality and legal capacity, which constitute a corner stone notion in the human rights doctrine. Therefore, any legislative interference in this issue must observe this sensitivity and take it into consideration, so as to be minimal and restricted within a narrow and rational scope. Otherwise, such interference will be odd and receives criticisms. This study explores and evaluates the legal rules related to Terminal Disease in both Jordanian Civil Law and the Qatari Civil Law, so as to introduce some new approaches for possible reform. |
