| Abstract | هدفت هذه الدراسة إلى محاولة التخفيف أو الحد من المشكلات المترتبة على إيقاع الطلاق التعسفي وذلك من خلال مقترح التأمين التعاوني، والذي يضمن للزوجة الحياة الكريمة بعد الطلاق، وعدم تعرضها للباءة والفقر؛ ,وقد تمثلت إشكالية البحث في السؤال الآتي: ما مدى إمكانية تطبيق فكرة التأمين ضد التعسف في الطلاق في المجتمع القطري، وذلك من خلال البحث في حقيقة التأمين في الشريعة الإسلامية، بتعريفه وبيان أنواعه، والفرق بينه وبين التأمين التعاوني، بالإضافة إلى أبرز الضوابط التي تضمن عدم التلاعب بالطلاق طمعا في الحصول على مبالغ التأمين ولهذه الدراسة أهمية كبيرةً في المجتمع القطري وذلك بإلقاء وتسليط الضوء على موضوع التعسف في الطلاق، وتخصيصه بالمزيد من الاهتمام، والدعوة إلى مقترحات جديدة من شأنها أن تحد منه لانتشاره الواسع، لما يترتب عليه من أضرار للزوجة والأسرة والمجتمع؛ وقدمت الدراسة اقتراحات لدراسة آلية سير وتطبيق التأمين ضد التعسف في الطلاق؛ وتوصلت إلى نتائج فيها الترحيب الواسع للمجتمع القطري بمقترح التأمين ضد التعسف في الطلاق من خلال نتائج الاستبيان الذي ضم ما يفوق 500مستجيب، بالإضافة إلى دعوة مجموعة من الشخصيات العلمية الذين تمت مقابلتهم إلى ضرورة وضع مجموعة من الضوابط لتطبيق المقترح بما لا يتعارض مع المقصد الأساسي منه. |
