| Abstract | تخضع عقود إشغال اموال العامة لمبدأ الحرية الاجرائية في فرنسة، تحرر الادارة من كافة الاجراءات المسبقة اللازمة لإبرام العقد والتي ينص عليها المشرع، ولاسيما تلك الاجراءات المتعلقة بالعلانية والمنافسة، وقد ساق الفقه الفرنسي مبررات عديدة لذلك، وفي نفس الوقت كان هذا الوضع مثار انتقاد هذا الفقه ذاته. وإن هذا المبدأ المتعلق بالحرية الاجرائية يخضع لاستثناءات عديدة في فرنسة منها ما هو مقرر بمقتضى النصوص، ومنها ما هو راجع لفعل الادارة ذاتها حين تلزم نفسها باتباع اجراءات المنافسة والعلانية، ومنها ما هو راجع للاجتهاد القضائي وذلك من خلال إمكانية إعادة تكييف عقد الإشغال إلى عقد آخر خاضع لالتزامات المنافسة الحرة والعلانية، وفي إمكانية الخضوع لالتزامات العلانية المسبقة والمنافسة الحرة، نتيجة دخول الإشغال ضمن مركب عقدي يخضع في كليته لهذا الالتزام. ومن جانب آخر فإن عقود اشغال الاموال العامة تخضع لالتزامات المنافسة والعلانية في فرنسة من خلال إدراج قانون المنافسة في كتلة المشروعية، وهو ما يضع التزاماً هاما على عاتق الإدارة المالكة للمال العام، ومناط هذا الالتزام أن تبرم عقود إشغال المال العام ضمن إجراءات تنافسية. |

| Alternative Abstract | In France, contracts related to using public funds are subject to the principle of procedural freedom, freeing the administration of all prior procedures required for the conclusion of the contract and which the legislature has stipulated, especially those procedures related to openness and competition. French jurisprudence has provided many reasons of justification for that and at the same time this situation is subject to the criticism of the jurisprudence itself. The principle related to the procedural freedom is subject to many exceptions in France. From these are those which have been decided by the legal texts, some relate to the act of the administration itself when it binds itself willingly to following procedures of competition and openness, some relate to judicial deduction and that is through the possibility of readjusting the works contract to another which is subject to the requirements of free competition and openness, or the possibility of being subject to prior openness and free competition requirements, as the result of the works entering within a contract bundle which as a whole is subject to such requirements. From another angle, the contracts utilizing public funds are subject to competition and openness requirements in France by incorporating the competition law within the cluster of legalities. This is what places an important commitment upon the shoulders of the administration possessing the public money and the applicational reality of this commitment is that the contracts utilizing public funds are concluded within competitive procedures. It is noticeable in both Syria and Qatar, that concluding contracts related to the works of public funds is not subject to the principle of procedural freedom. That is in accordance to the dictates of the legal texts which govern the contracts of public sales, which stipulate that the conclusion of contracts related to investment and renting properties which belong to public money or private money of the administration, be subject to the general method of bidding. This is an approach which assumes the fulfilment of the requirements of competition and openness, although adopting this approach to conclude these contracts is no longer sufficient, as public bidding is undertaken only upon one single factor and that is the highest price or offer. |
