| Abstract | يُعنَى هذا البحث بدراسة مدى قوة الدليل العام في معارضة الدليل المخصِّص، بحيث يُقدّم عليه في كثير من المسائل، حيث انتهج الباحث فيه المنهجين الستقرائي والتحليلي، لسبع عشرة مسألة -وهي أكثر - خالف فيها الإمام مالك وأصحابه الدليل الخاص، وتمسكوا بمدلول العام؛ لرجحان قوة العام بضمائم تورث في النفس اطمئنانا إلى التمسك به وتضعيف الدليل الخاص في الموطن المعين أو تأويله، حيث استطاع الباحث دراسة كيفية تعاملهم مع كل مسألة من تلك السبع عشرة، واستخراج قواعد مشتركة وضوابط في تعاملهم مع النصوص العامة والخاصة عند ظهور تعارضها، مع عدم إغفال ضوابط الفتوى وقيودها المانعة من التفلت فيها والتفريط في التخصيص . |

| Alternative Abstract | This research is concerned with investigating the strength of the General Evidence in opposing the Specifying Evidence, where the General Evidence prioritized in many issues. The researcher adopted the inductive and analytical approaches, for seventeen issues in which Imam Malik and his companions disagreed with the specific evidence, and hold on to the meaning of The General Evidence, due to the strength of the General Evidence because of some related sub-evidence which make them more comfortable to hold on to the meaning of the General Evidence and weaken the Specifying evidence in the particular issue or interpretate it. The researcher was able to study how they dealt with each of those 17 issues, and extract common rules and controls in their dealings with General and Specifying texts when their conflict appears, while not losing sight of the fatwa's controls and restrictions that prevent them from getting away with them and over-specifying them. |
