| Abstract | مع ظهور فيروس كورونا المستجد (Covid-19) تسابقت شركات الأدوية لصنع أدوية ولقاحات يمكن لها شفاء المصاب بفيروس كورونا، أو منع إصابته بها. وقد أثار ذلك التسابق العديد من الإشكاليات القانونية التي تنظم مسألة التجارب الطبية لهذه الأدوية؛ وصولًا إلى موافقة المؤسسات والوكالات والوزارات المختصة على إنتاجها وتوزيعها وطرحها للعموم، وبخاصة أن مدة تجربة اللقاح لم تأخذ وقتًا كافيًا حسب المعدل المتعارف عليه عالميًا؛ مما يطرح تساؤلًا حول نجاعة هذا اللقاح ومخاطره، وبخاصة بعيدة المدى. وللإجابة عن هذه التساؤلات تبحث هذه الدراسة في مدى مشروعية التجارب الطبية التي تجرى على الأشخاص الأصحاء والمرضى، والشروط الواجب توافرها في التجارب الطبية لتكون مشروعة. كما تبحث في مدى مسؤولية صانعي الأدوية واللقاحات بعد الموافقة عليها من الجهات المختصة عند تسببها بأضرار للأفراد. وقد توصلت الدراسة بعد استعراض بعض القضايا المقارنة والحوادث الطبية إلى أن المسؤولية مشتركة بين الأطباء والصيادلة ومنتجي الأدوية؛ كلٌّ بحسب التزامه. |

| Alternative Abstract | With the appearance of the Corona Virus (Covid-19), the medicine producers raced to produce a medicine and vaccines that prevent and heal patients infected with this virus. This racing has raised many controversial legal issues of medical experiments and regulations until the institutions, agencies and ministries approve the production and distribution of the medicine, especially when the duration of experiments did not take an adequate time according to the international standards. This gives inquiries about the effectiveness and hazards of such vaccinations, especially on the long run. To answer these questions, this research studies the legality of medical experiments conducted on sick and healthy people, and the conditions that must be met to be legitimate. In addition, it examines the liability of companies who manufacture these medicines and vaccines in case of caused harm to healthy and sick people. |
