| Abstract | تتحقق عمليات التركّز الاقتصادي نتيجة تصرفات تقوم بها المشروعات التجارية، تكون الغاية منها التوحّد في مشروع أضخم، أو تحقيق السيطرة من قبل مشروع تجاري على مشروع، أو مشروعات أخرى. لذا، تعتبر عمليات التركّز أداة مهمّة لتطوير العمليات الاقتصادية، والتحكم في مدخلات السوق ومخرجاتها؛ بما تحققه من وضع مهيمن، يسيطر على إمكانياتها، ويؤثّر تأثيرًا فاعلًا على المنافسة بين القطاعات الاقتصادية. وللحفاظ على تسيير العمليات الاقتصادية المرتكزة على عمليات التركّز الاقتصادي؛ فقد اتجهت التشريعات إلى وضع قواعد فاعلة؛ لإيجاد التوازن بين تطوير العمليات الاقتصادية وإنمائها من جهة، وبين السيطرة على تغوّل المشروعات المهيمنة والحد من قدرتها على التحكم بالسوق بما يضر بالمنافسة المشروعة من جهة أخرى. في ضوء هذه المعطيات؛ ركزت هذه الدراسة على تحليل النصوص التشريعية في التشريعين الأردني والقطري؛ لبيان مدى قدرتها على إيجاد التوازن المنشود بين المشروعات المهيمنة ومُكْناتها المسيطرة، وبين إمكانية التزام تلك المشروعات بقواعد المنافسة والنأي عن منعها، أو الحد منها. وقد توصلت الدراسة إلى نتيجة مفادها؛ ضمان تلك الموازنة بما يحقق غايات هذه العمليات؛ للنأي بها عن الإضرار بالعملية الاقتصادية. |

| Alternative Abstract | Economic concentration processes occur as a result of actions carried out by commercial projects aiming at joining together in a bigger firm, or achieving control by one enterprise over another or others. Therefore, it is considered an important tool for improving business performances and controlling the input and output of the market, through the situation of controlling its capabilities and affecting competition among economic sectors. So laws tend to set effective rules to strike balance between improving economic transactions on the one hand, and controlling the dominant position abuse on the other hand. based on this; This study concentrates on discussing the legislative aspects of this issue, through analysing the legislative texts in Jordan and Qatar, so as to show the ability of these texts to strike the balance between the dominant position, and the ability and necessity for those firms to comply with competition rules and avoid reducing or restricting them. The study reached the conclusion that ensuring balance is achieved in order to reach the goals of these operations to prevent the abuse of dominant position. |
