| Abstract | أصبح التأمين الصحي من متطلبات الحياة المعاصرة وانبنت عليه مصالح كثيرة والشريعة راعية للمصالح. وقد حصل جدل فقهي في حكمه خلص فيه المجمع الفقهي قبل عشرين عاما إلى المنع. وهذا البحث إعادة للنظر بعد هذه المدة الطويلة ودراسة تأصيلية تستعرض الحجج وتناقشها وتدرس إشكاليات التخريج الفقهي في عقد التأمين وإشكاليات أدلة المنع، وقد أجاب البحث عن تساؤلات عديدة، ماهو التأمين وماهيته الشرعية؟ وما صور عقود التأمين الصحي؟ وما يندرج فيه من العقود. ثم وضع البحث طريقين لبيان حكمه، الأولى: التخريج على عقد سابق في التراث الفقهي ومناقشة الإشكالات التي وردت عليه، والأخرى: البحث عن أصوله من كتاب وسنة وقواعد الشريعة، وبعد هذه الرحلة الفكرية والفقهية خلص البحث إلى الجواز. |

| Alternative Abstract | Health insurance has become one of the requirements of contemporary life and has built many interests on it and Sharia is a sponsor of interests. There was a jurisprudential debate in his ruling, in which the Fiqh Council concluded 20 years ago. This research is re-examined after this long period and a thorough study that reviews the arguments and discusses them and examines the problems of the jurisprudential graduation in the insurance contract and the problems of the prevention evidence. The search answered many questions about insurance and its legal nature and the pictures of health insurance contracts and what is included in the contracts. On the previous contract in the jurisprudential heritage and discuss the problems that have been received, and the other search for the origins of the book and the year and the rules of the law and after this journey intellectual and jurisprudence concluded the search to the passport and answered the problems of jurisprudence that oppose the passport. |
