| Abstract | تهدف الدارسة إلى توضيح بعض حالات التعارض الظاهري بين المفهوم والمنطوق، من خلال كتاب إحكام الأحكام شرح عمدة الأحكام لابن دقيق العيد وكيفية دفع هذا التعارض، وذلك بذكر الأمثلة على الحالات التي نص عليها ابن دقيق العيد وبيان طريقة دفع التعارض بين المفهوم والمنطوق من خلال كلام ابن دقيق العيد وكلام أهل العلم، واعتمد البحث على المنهج الوصفي لبيان المفاهيم والمنهج التحليلي المقارن لتحرير المسائل والموازنة بينها والمنهج الاستقرائي لتتبع المسائل والأمثلة في كتاب الإحكام، ويحتوي البحث على بيان حقيقة مصطلحات البحث، والمسائل ذات الصلة بتعارض المفهوم والمنطوق، وتطبيقات تعارض المفهوم مع المنطوق من خلال كتاب إحكام الأحكام، وخلص البحث إلى أن قاعدة ترجيح المنطوق على المفهوم ليست بإطلاقه، فإذا تعارض دليلان ولم يمكن الجمع بينهما وذلك إذا كان المفهوم والمنطوق خاص ا أو إذا كان كلاهما عاما، هنا نقدم قاعدة المنطوق على المفهوم. وإذا تعارض دليلان وأمكن الجمع بينهما وذلك إذا كان أحدهما عام ا والآخر خاصا، حصل خلاف بين العلماء في تقديم المنطوق على المفهوم أو العكس في هذه الحالة |

| Alternative Abstract | This study aims to clarify some cases of contradictions between concept )المفهوم( and the application )المنطوق( in light of the book called “Kitab Ihkam al-Ahkam.” (An explanation of Umdat al Ahkam by Ibn Daqiq al Eid on how to resolve such seeming contradictions) The treatise relies on examples laid out by Ibn Daqiq al-Eid as the way to refute and clarify conflicts in texts between the understood concept )المفهوم( and the applied practices )المنطوق( in Islamic Fiqh through the words of Ibn Daqiq al-Eid along with other scholars. This research is based on a descriptive approach to explain Islamic concepts, and a comparative approach to evaluate issues and balancing them, as well as an inductive approach to follow issues and examples in “Kitab Ihkam al-Ahkam.”. The research concluded that the principle rule of giving preference to the practiced )المنطوق( over the concept )المفهوم( is not meant to free it from restrictions. This is done in the case where two evidences contradict and it is not possible to combine them: If the concept )المفهوم( and the practiced )المنطوق( are specific )خاص( or if both are general )عام(, then we apply the rule of the practice )المنطوق( over the concept )المفهوم(. However, If the two evidences contradict and it is possible to combine them; that is, if one of them is general )عام( and the other is specific )خاص(, then the scholars differed as to which takes precedence: the practice )المنطوق( over the concept )المفهوم( or vice versa . |
