| Abstract | يتفق المجتمع الرياضي المحلي والدولي على أهمية الالتزام بقواعد النزاهة في الرياضة. والنزاهة في الرياضة هو موضوع هذا البحث، الذي يتناول بصفة أساسية المعايير الدولية وأثرها على التشريعات الوطنية؛ خاصةً القانون الرياضي القطري ومدى تأثيره على صياغة العقود الرياضية. ونحن نتعرض إلى الإشكاليتين معًا، بطرح مفهومين جديدين، نطلق على الأول "القانون الرياضي الدولي" ونطلق على الثاني "النظام العام الرياضي". وفي هذا البحث، نشرح بالتفصيل الاتفاقيات الدولية ذات الصلة بالعمل الرياضي، وبصفة خاصةً اتفاقية الأمم المتحدة لمكافحة الفساد، والاتفاقية الدولية لمكافحة المنشطات في الرياضة، واتفاقية مجلس أوروبا بشأن التلاعب في المنافسات الرياضية. ثم نتطرق إلى النصوص التعاقدية التي تراعي القواعد الواردة في هذه الاتفاقيات. ونخلص إلى توصيتين؛ الأولى: نداء بوضع خطة وطنية لدولة قطر يراعى فيها رباعية تتمثل في الأخذ بالتدابير الاحترازية في التوعية، والملاحقة القضائية بناءً على قواعد محددة في التجريم والعقاب، والحماية والمساعدة، خاصةً للفئات المستضعفة التي يتعين إيلائها حماية خاصةً حتى تتمكن من الاشتراك في المنافسات الرياضية دون عوائق أو صعوبات. وأخيراً، التعاون والتشارك وتبادل المعلومات، وذلك على المستويين الوطني والدولي. أما التوصية الثانية، فهي صياغة ميثاق للنزاهة الرياضي يستند إلى التشريعات الوطنية المختلفة ويأخذ في ذات الوقت بالمبادئ العامة المتعارف عليها في المستوى الدولي، واحترام حقوق الإنسان، وعدم التمييز، والخصوصية، والحياد، والعدل والإنصاف، والنزاهة والشفافية، والاحترام المتبادل، والمسؤولية المهنية، والتناسب. |

| Alternative Abstract | The local and international sports community agree on the importance of adhering to the rules of integrity in sport. Integrity in sport is the subject of this research, which mainly studies international standards and their impact on national legislation; especially the sport’s related laws in Qatar and its impact on the drafting of sports contracts. We address the two issues together, by introducing two new concepts. We refer to the first "International Sports Law" and the second "Sports Public Order". In this thesis, we discuss and analyze in detail the international conventions related to integrity in sports, in particular the United Nations Convention against Corruption, the International Convention against Doping in Sport, and the Council of Europe Convention on the Manipulation of Sports Competition. Then we will analyze the contractual obligations taking into account the rules contained in these International Conventions. We conclude with two recommendations; The first: a call for the development of a national action plan for the State of Qatar that takes into account the quartet of taking precautionary measures in raising awareness, prosecution based on specific rules in criminalization and punishment, protection and assistance; especially for vulnerable groups that must be given special protection so that they can participate in sports competitions without obstacles or difficulties. Finally, cooperation, sharing and information exchange, at the national and international levels. As for the second recommendation, it is the formulation of a Qatari Sports Code of Ethics based on the various national laws and at the same time taking into account the general principles of universality, respect for human rights, non-discrimination, privacy, impartiality, fairness and equity, integrity and transparency, mutual respect, professional responsibility, and proportionality. |
