| Abstract | انتشر في الآونة الأخيرة تداول مصطلح "الاقتصاد الدائري" في المنابر والمحافل الدولية المهتمة بقضايا البيئة والاقتصاد، وسرعان ماطال هذا المصطلح مؤسسة القانون مغيراً بُنيتها تغييراً ملحوظاً في كثير من الأقاليم. تتناول هذه الرسالة في مطلعها مفهوم الاقتصاد الدائري ، ثم تُسهب متناولةً الصور التي يتخلل بها هذا المفهوم الأنظمة التشريعية المختلفة، بداء من هيمنته على النصوص القانونية المتعلقة بالإنتاج وتحويله إلى إنتاج نظيف عن طريق مجموعة مبادئ قانونية لبد وأن تطال المُنتَج والمُنتِج على حد سواء، ومروراً بتنظيمه لأنماطِ استهلاك نظيفة يلتزم بها الشخص المادي والمعنوي في معرض تداوله لسلعة ما، وانتهاء بوضعه حداً للتخلص العشوائي والتقليدي للنفايات، وإعادتها للحياة مرة أخرى بإرجاعها للنظام الاقتصادي عن طريق إعادة الاستخدام وإعادة التدوير. مشكلاً بذلك تحولا من نظام اقتصاد خطي ينتهي بالتخلص إلى نظام دائري يدور فيه المنتج داخل حلقة مغلقة، وذلك عن طريق مجموعة أدوات قانونية تكفل عامليّ الجدية و الفاعلية، تتبع هذه الرسالة منهجاً تحليلياً في تحليل وإسقاط النص القانوني على الواقع، ومقارناً للمقارنة بتجارب غربية رائدة في المجال. |

| Alternative Abstract | Recently, the term "circular economy" has been prevalent in the discussions of international forums and platforms concerned with environmental and economic issues. Soon after, the term managed to infiltrate the institution of law, fundamentally changing its structure in many regions across the globe. This thesis will initially tackle the concept of “circular economy”, and then it will proceed to elaborate on the various ways in which this concept permeates various kinds legislative systems, starting with how it reigns over legal texts concerned with the subject of transitioning towards clean methods of production by enforcing legal principles which affect producer and product alike, then addressing the role it plays in the regulation of clean consumption patterns that natural and juristic persons should commit to when trading commodities, and finally discussing its function in eliminating the use of haphazard and traditional methods of waste disposal, and rejuvenating the practice by reintegrating it into the economic system through reuse and recycling, thus going from a linear economic system that ends with the process of disposal, to a circular system in which the product continues to be indefinitely circulated within a closed chain, through a set of legal instruments that can ensure that the implementation will be done in a serious and effective manner. This thesis shall follow an analytical approach for the analysis and the real-life application and integration of the legal text, and a comparative approach when drawing comparisons with the best experiences of Western pioneers in the subject field. |
