| Abstract | تحظى الرياضة بمكانة هامة على المستويين الوطني والدولي على اعتبار أنها أضحت تمثل الطرائق المهمة لتدعيم العلاقات الإنسانية بين مختلف شعوب العالم، علاوة على أن تأثيراتها لم تعد مقتصرة على المجتمع الرياضي دون سواه، بل إن أثرها امتد كذلك ليشمل أشخاص القانون الخاص المعنيين بتجارة وصناعة الرياضة، مثل الشركات الراعية للتظاهرات الرياضية الكبرى، والمؤسسات الخاصة بالإعلام والدعاية. إن كل هذه التطورات المتسارعة التي شهدها الحقل الرياضي بصفة عامة، أفرز واقعا جديدا تضمن ظهور الكثير من المنازعات الرياضية التي تفردت بطبيعة وخصائص مميزة لها، وذلك تحديدا من جهة طبيعة أشخاصها، وارتباط موضوع النزاع بالنشاط الرياضي قصرا. وعليه جاءت هذه الدراسة لتتناول وسائل فض المنازعات الرياضية في دولة قطر، وذلك من خلال فصلين جامعين، يتناول الفصل الأول ماهية المنازعات الرياضية وذلك من خلال بيان مفهوم المنازعات الرياضية وأنواعها، علاوة على توضيح الخصوصيات التي تتمتع بها. في حين تناول الفصل الثاني، وسائل فض المنازعات الرياضية، وذلك من خلال بيان الوسائل القضائية لفض المنازعات الرياضية؛ المتمثلة أساساً في القضاء العادي، إلى جانب الوسائل الأخرى الغير القضائية كالتحكيم والوساطة والتوفيق، سواءً أكان ذلك في دولة قطر أو في بعض الدول المقارنة. كما توصلت هذه الدراسة إلى العديد من النتائج والتوصيات، أهمها أن هذه المنازعات الرياضية في دولة قطر ينعقد الاختصاص بشأنها للمحاكم المحلية بالأصالة، أو مؤسسة قطر للتحكيم الرياضي، وذلك بحكم أنهما الجهتين المختصتين في المنازعات الرياضية، في ظل غياب سلطة قضائية مختصة بذلك. في حين تعلقت أهم التوصيات بضرورة سن قانون خاص بالرياضة، تكون مهمته الرئيس تنظيم المسائل الرياضية في دولة قطر، والعمل على فض المنازعات الرياضية لما لهذا الأمر من أهمية كبيرة. |

| Alternative Abstract | Sport has assumed a significant position at the national and international levels as it has become one of the important ways to strengthen human relations between all the peoples around the world. Moreover, its effects are no longer restricted to the sports community, but have extended to include private legal persons involved in sports trade and industry such as companies sponsoring major sports events, as well as media and advertising institutions. All of these rapid developments in sports field, resulted in a new reality including the emergence of many sports disputes -unique in their nature and characteristics, specifically in terms of the nature of their persons, and the relation of the dispute’s subject with sports activity exclusively. Accordingly, this study came to address the methods of resolving sports disputes in the State of Qatar in two comprehensive chapters. The first chapter tackled the nature of sports disputes and clarifies their concept, their types, and their own peculiarities as well. While the second chapter dealt with the methods of settling sports disputes by explaining the judicial methods for settling them. Such ح methods are embodied mainly in the ordinary courts, in addition to other non-judicial methods such as arbitration, mediation and conciliation, whether in the State of Qatar or in some comparable countries This study also reached a number of conclusions and recommendations, the most important of which is that these sports disputes in the State of Qatar fall initially under the jurisdiction of the local courts, or the Qatar Sports Arbitration Foundation, because they are the two qualified authorities preoccupied with sports disputes, in the absence of a specialized judicial authority. While the most important recommendations are related to the necessity of enacting a sports law, whose main task is to organize sports issues in the State of Qatar, and to work on resolving sports disputes because of its great significance. |
