| Abstract | ينطلق البحث من ملاحظة توارد ذكر أصل القياس وتوابعه في مباحث أصول الفقه الأخرى غير مباحث القياس، ويهدف إلى دراسة علاقة القياس بالمصلحة المرسلة والمفهوم المخالف وتقييد المطلق، وذلك من خلال النظر إلى جوانب الاتفاق والافتراق، كالتأثر بالتعليل، والتشابه في مآخذ الاحتجاج، وغير ذلك من موارد العلاقة، وانتهج البحث منهجين: المنهج الوصفي في تحرير المصطلحات والمفاهيم، والمنهج التحليلي في استخراج جوانب العلاقة اتفاقًا وافتراقاً، وقد استنتج أموراً عدة، أهمها: أن المصلحة المرسلة مرجِّحٌ مركب من عدة أصول شرعية أحدها القياس، وأن القول بتقييد المطلق مبني على حجية المفهوم المخالف؛ لأن القيد هو مفهوم الصفة سواء بسواء، وأن هذه العلاقة تأثرت بعلاقة أخرى مع القياس من جهة التأثر بالدلالة العقلية القياسية، والتأثر بمسالك علة القياس كمسلكي الإيماء والمناسبة، وكذلك تطابق المفهوم المخالف مع قياس العكس في بعض صوره. |
