| Abstract | تعتبر المرجعية الفقهية من أهم القضايا المنهجية في الاجتهاد والفتوى، ويتجدد البحث فيها كلما استجدت الحوادث والنوازل، فقد كان لجائحة فيروس كورونا المستجد (كوفيد-19) أثر في استدعاء هذا الموضوع من خلال ما اشتملت عليه فتاوى فيروس كورونا المستجد (كوفيد-19) من احتكام إلى الكليات العامة، واتسمت تلك الفتاوى بالمنطق التشريعي الكلي، فجاءت فكرة البحث بهدف رصد فتاوى أشهر المجامع الفقهية والهيئات الإفتائية، وبيان مدى ما تمثله تلك الكليات الواردة فيها من إطار مرجعي للفتوى المتعلقة بجائحة كورونا، وإبراز ذلك من خلال النماذج التطبيقية للفتاوى مبوبة بحسب القواعد والكليات التي احتكمت إليها، وقد اشتمل البحث على نماذج من احتكام تلك الفتاوى إلى القواعد المقاصدية، كاعتبار المصالح ودرء المفاسد والموازنة بينها، واعتبار المآلات وسد الذرائع، إضافة إلى نماذج من الاحتكام إلى القواعد الفقهية، كقواعد الضرو ا رت والمشقات، ودفع الضرر، وتقييد المباح، وغيرها، وقد تبين من خلال البحث أن الكليات العامة تمثل إطارا مرجعيا وشرعيا للفتاوى الفقهية ولا سيما في النوازل والجوائح مثل جائحة كورونا، وأن الاجتهاد في ضوء الكليات العامة يضمن استمرارية الفقه الإسلامي في تقديم الحلول الشرعية لتعقيدات الحياة المعاصرة، وتبين أيضا أن الاحتكام إلى الكليات العامة منهج أصيل في استنباط أحكام النوازل الفقهية، وأن جهات الفتوى تستند إلى الكليات العامة دون استثناء على تفاوت بينها في ذلك الاحتكام. |

| Alternative Abstract | The jurisprudence reference is one of the important issues in diligence and Fatwa, and the research in it is renewed whenever accidents and disasters occur. Corona pandemic had an effect on this recalling subject through the inclusive Corona Fatwas by referring to general universalities. Such fatwas were characterized by the total legislative logic; hence, the idea of research emerged with the aim of observing the Fatwas of the most famous jurisprudential councils and the Fatwas Commissions, and to show what such universalities represent in terms of reference framework of the Fatwa related to Corona pandemic; and to highlight this through the applied models of Fatwas, classified as per the referential rules and universalities. The research included samples of Fatwas, which referred to intentional rules, such as considering interests, preventing vices, comparing among them, considering the consequences and cutting out the excuses; in addition to samples of referring to jurisprudential rules, such as the rules of necessity and difficulties, and preventing harm, restricting the permissible and others. It was indicated through the research that the general universalities represent a referential and legislative framework for jurisprudential Fatwas, especially in disasters and pandemics, such as Corona pandemic, that diligence in the light of general universalities includes the continuity of the Islamic Jurisprudence in presenting legislative solutions for the contemporary life complications. Moreover, it also became clear that referring to the general universalities may contain probability and disruption, mostly due to lack in achieving the motive of such universalities, and the authorities of Fatwas depend on the general universalities without exception though they are different in that reference. |
