Abstractتوسعت الدعاوى الوقفية في دولة قطر خلال العقود الماضية، وفي آخر ربع قرن تحديداً، وذلك على نحو ملحوظ، ومرجع ذلك إلى التطورات الاقتصادية والاجتماعية التي شهدتها البلاد خلال الفترة المذكورة، ونظراً لذلك، جاء هذا البحث ليبين تأثيرات هذه الدعاوى في السياق القطري، ويستجلي الطرق المناسبة لمعالجتها بما يضمن سلامة الوقف من آثارها، وذلك في إطار وصفي تقويمي لواقع هذه الدعاوى وإجراءاتها. وفي سبيل تحقيق ذلك قام الباحث بجمع واستقراء المعلومات المتعلقة بالموضوع من مصادرها، ودراستها وتحليلها للاستعانة بها على حل مشكلة البحث، إضافة إلى المقارنة بين مواقف المذاهب الفقهية في مسائل البحث من جهة، وبينها وبين القانون القطري من جهة أخرى، حيث تعرض البحث لبيان الإطار المفاهيمي والتشريعي للوقف ودعاواه، وتوصيف مؤسسة الوقف ونظامه في دولة قطر، ثم تطرق إلى واقع الدعاوى الوقفية في الفقه الإسلامي والقانون القطري، سواء أكانت عائدة إلى الواقف أو الموقوف عليه أو الناظر، وانطلق بعدها للحديث عن الطرق الرسمية والطرق الودية البديلة لتسوية الدعاوى الوقفية، إضافة إلى وسائل الإثبات فيها. وبعد هذه الرسالة توصل البحث إلى نتيجة إجمالية مفادها أن للدعاوى الوقفية تأثيراً سلبياً على الوقف، إلا أنه تأثير محدود من حيث الجملة، وذلك نظراً للتنظيم المؤسسي والقانوني المحكم للوقف في دولة قطر، إضافة إلى أن النظام القضائي الذي يحسن تطبيق القوانين المتعلقة بالوقف، ورغم ذلك فإن هذا التأثير جدير بالمعالجة. كما توصل البحث إلى وجوب مراعاة قواعد المصلحة الشرعية، والحرص على تحقيق مصالح الوقف عند معالجة الدعاوى الوقفية وآثارها. كما أوصى البحث بأهمية العناية بقانون الوقف وتطويره، إضافة إلى إعمال الطرق البديلة من وساطة وتحكيم وصلح في حسم الدعاوى الوقفية.

Alternative AbstractWaqf Lawsuits have remarkably evolved in Qatar in the past few decades. This is due to socio-economic developments being witnessed in the country within the above mentioned period. As such, this research explained effects of such lawsuits in the Qatari context. It explored appropriate ways by which to address such lawsuits so that they will not adversely affect the subject matter of Waqf. This was done by describing and evaluating the status and procedures of such lawsuits. To achieve this purpose, the researcher has gathered and generated data relating to the subject from various sources with a view to studying and analyzing them as a way of addressing the research problem. Also, positions of schools of jurisprudence on specific cases of the research were studied in a comparative manner on one hand, while those positions were compared with the Qatari law on the other hand. In other words, the research studied the conceptual and legal framework of Waqf and lawsuits, thereby giving a clear description of the Waqf institution and organization in Qatar. It also analyzed the nature of Waqf lawsuits in the Islamic jurisprudence and the Qatari law as it relates to the donor or the subject matter or the administrator. After this, it discussed alternative official and friendly ways of settling Waqf lawsuits and means of proof. The research arrived at a general finding to the effect that lawsuits on Waqf have a negative effect on the institution of Waqf. Yet, this effect is generally limited due to the solid institutional and legal organization of Waqf in Qatar. In addition, there is a judicial system in place in Qatar that perfectly applies all laws relating to Waqf. Despite this, the negative effect needs to be addressed. The research also found that it is mandatory to consider the principles of maslahah of the Islamic law and ensure that objectives or benefits of Waqf are realized when the lawsuits of Waqf and their consequences are addressed. Finally, the research recommended that the law of Waqf and its improvement should be considered paramount. This is in addition to the need to evolve alternative ways like mediation, arbitration, and reconciliation through which Waqf lawsuits can be settled.
