| Abstract | لقد عد الإسلام حق الشفعة من الحقوق المكفولة للشريك في حالة قام شريكه ببيع نصيبه على أجني، وذلك لدفع ضرر الشركة عن الشريك القديم. تناولت الدراسة مدى تأثير الوقت في شفعة الحاضر من حيث وقت الأخذ بالشفعة بعد العلم بها من حيث الفور أو التراخي، وبيان المدة التي تعطى للشفيع على قول التراخي، والمهلة التي تعطى للشفيع لإحضار الثمن إذا ما رغب بالشفعة، وبيان حكم أخذ الصغير بالشفعة بعد بلوغه، وأيضا إيضاح الأعذار التي لا تضر تأخير وقت طلب الشفعة والتي تضر، وكذلك موضوع عدم تصديق الشفيع للمخبر، وكذب المخبر في بعض تفصيلات الشفعة وتأثير ذلك على تأخر الطلب للشفعة، كما بينت تصرفات الشفيع القولية والفعلية وتأثيرها على حق الشفعة. |

And explain the firming relating to the young taking the preemption when he puberty. And explain the excuses which dos not effect on preemption, or effect. And belief the intercessor informer or not about preemption details. And the study explain the Intercessor's actions and actual anecdotal and its effects on preemption. |
