| Abstract | تقرر تشريعات الملكية العقارية مبدأ حجية الشهادات العقارية الصادرة من دوائر الشهر العقاري. والشهادة الصادرة، وفقا للاشتراطات الشكلية والموضوعية، حيث تعتبر، وبحسب الأصل، حجة في مواجهة الكافة بلا استثناء. فتثبت بها ملكية العين العقارية محل السند بأوصافها الواردة في ذلك السند وباسم الشخص المذكور فيه حصرا. ويحصل في بعض الأحيان، وخاصة بين الزوجين، أن تساهم الزوجة بعمل أو مال في شراء عقار أو أكثر. وبعد الطلاق أو الوفاة يحتج الزوج أو ورثته بالسند الرسمي الذي يعده المالك الوحيد لأنه المالك المسجل. فهل من حسن النظر عدلا أن تبقى الشهادة عنوانا للحقيقة في شأن إثبات ملكية الزوج وحدودها؟ في القوانين الانكلوسكسونية المقارنة وخاصة قانون الملكية العقارية الإنجليزي والاسترالي طرح القضاء مبدأ الأمانة المفترضة (Constructive Trust) فبموجب هذا المفهوم لا يمكن للزوج الاحتجاج بالسند العقاري في مواجهة الزوجة ويمكن للأخيرة اثبات مساهمتها المباشرة من خلال المال أو العمل في تحصيل ملكية العين محل النزاع. فهل يمكن الوصول للنتيجة ذاتها في القوانين العربية؟ سيسعى هذا البحث للإجابة عن هذا السؤال وفقا لما هو كائن وما يجب أن يكون في التشريعات العربية مع الاسترشاد بأصول التشريع الإسلامي ومقاصده في إطار مقارن. |

| Alternative Abstract | Comparative real property laws deem certificates of ownership as indefeasibe proof of ownership once issued by a competent government registrar of real property. The certificate of ownership that satisfies formal and substantive legal requirements can be enforced against any and all third parties. It is the frame of reference for the identity of the registered proprietor as well as the property rights and encumbrances related to the house or land. In many cases involving family disputes, especially among spouses, a family member would contribute with money or labour towards acquiring the ownership of the property. However, after divorce, one of the spouses, usually the husband, would claim exclusive property ownership since he is the only registered owner. Would this outcome be fair in situations where the wife has already contributed to the ownership but without being included in the certificate of ownership? In common law jurisdictions such as the United Kingdom and Australia, courts have established the doctrine of constructive trust. Under this doctrine, the husband as the registered proprietor cannot rely on the indefeasibility of the certificate of ownership to the exclusion of his wife if the wife can prove that she made monetary or non-monetary contributions towards aquiring ownership. One might ask, would it be possible to arrive at the same conclusion under property laws in the Arab world? This paper will address this question by investigating the current status of real property ownership and its limits compared to common law and Islamic jurisprudence. |
