| Abstract | هذه الدراسة تتحدث عن الجهات الخيرية ودورها في المجتمع من الناحية الفقهية والتَّأصيلية والنَّقدية، وتمحور حول التساؤل عن مدى تتطابق أعمال الجهات الخيرية في دولة قطر مع الضوابط الفقهية ومقاصد المتبرعين؟ وهذا التساؤل حمل الباحثة على التفكير في وضع مجموعة من الأسئلة والإجابة عنها في فصول ومباحث بعد الاعتماد على المنهج الوصفي التحليلي والمقارن والاستقرائي والميداني في جمع المادة العلمية لها. وهذه الدراسة تناولت في الفصل الأول حقيقة الجهات الخيرية من ناحية التعريف والنشأة في دولة قطر، وأهم مهامها، وفي الفصل الثاني تناولت التكييف الفقهي لإنشائها وتأسيسها وعملها، وأما في الفصل الثالث فتناولت بعض مصادر تمويل الجهات الخيرية في دولة قطر وأحكامها، وفي الفصل الرابع تناولت بعض مصارف هذه الجهات الخيرية، وفي الأخير خلصت الدراسة إلى عدة نتائج منها: جواز إنشاء الجهات الخيرية وفق ضوابط شرعية، وأن مصادر تمويل الجهات الخيرية ومصارفها تتنوع وتتجدد بمرور الزمن من جهة لأخرى. |

| Alternative Abstract | This study talks about charitable organizations and their role in the society in terms of jurisprudence, fundamentalism and criticism aspects, and is centered around the question of: to at what degree dose the charitable organizations in Qatar matches with religious rules of jurisprudence and the purposes of donors. This question led the researcher to think about proposing a set of questions and answer them in chapters and sections by using a descriptive analytical method, comparative and inductive in gathering the scientific material from the field. The first chapter dedicated to the reality of charitable organizations in terms of definition and their foundation in the State of Qatar, and their missions. The second chapter dealt with the adaptation of the jurisprudence of the establishment of charitable organizations and their functions. While the third chapter considered some sources of funding of the charitable organizations in Qatar and their rules, the fourth chapter dedicated for the spendings of these charities. Many results were concluded from the study, including: the possibility of establishing charitable organizations in accordance with legitimate rules, and the sources of funding of charitable organizations and spendings vary and change from time to another. |
