الإفساد البيئي - مفهومه ، ومظاهره وموقف الشرع منه

| Abstract | للشريعة موقف صارم في محاربة الإفساد البيئي تمثل بمصفوفة من التعاليم والآداب والواجبات وبحثنا هذا يدرس ظاهرة الإفساد البيئي من الناحية التشريعية في الإسلام. استهل البحث في مبحثه الأول بيان مفهوم الإفساد البيئي بالنظر لمفرداته ثم بالنظر إلى تركيبه اللقبي، فالبيئة هي مقر الحياة الانسانية ومقوماتها ومسخراتها بريها وبحريها وجويها. والافساد البيئي كل تصرف ضار مناف للمصلحة يترتب عليه إخراج مكونات البيئة عن إمكان الانتفاع بها كلا أو بعضا، وكل جزئية في التعريف مقصودة الذكر كما وضحناه في محله من البحث، ثم يمضي البحث في مطلبه الثاني ليكشف عن أهم مظاهر الفساد وآثارها وأسبابها بما يخدم تصور الحكم على المسألة، لأن الحكم على الشيء مبني على صحة تصوره. وفي هذا المطلب بين الباحث مظاهر الإفساد البيئي المتعلقة بأكبر وأهم مفردات البيئة كالماء والهواء والتربة ، وأهم أسبابها التي برزت في عصر الطفرة الصناعية الاستثنائية، وانتقل الباحث الى المبحث الثاني : الذي بين التشريعات والتعاليم والآداب في الشريعة الإسلامية التي تحمي البيئة من الفساد، وتدعو إلى محاربته والقضاء عليه وتطرق البحث لكثير من التشريعات من القرآن والسنة وما نص عليه فقهاء الأمة في حماية البيئة من الفساد في مفرداتها العامة والخاصة ـ الماء والهواء والنبات والحيوان والارض ،وما يتعلق بذلك من أحكام هامة وتشريعات ضرورية وحاجية وتحسينية |

| Alternative Abstract | Islamic law strongly condemns environmental destruction, represented in a wide variety of teachings, moral prescriptions and legal duties. This research paper examines the environmental destruction phenomenon according to the legal aspects in Islam. The paper begins by explaining the concept of environmental destruction based on a linguistic (denotative) and connotative analysis of the term. Thus, the environment is the place where humans live; it is their most important asset and tool whether on the earth, in the sea or in the sky. Environmental destruction is any act, which harms or impedes public interest. Consequently, it refers to over-exploiting resources till they cannot be used completely or partially. Every word in the definition is intended as is explained in the paper. The paper then proceeds to discuss the most important manifestations, effects and causes of environmental destruction to illustrate the reality on which the legal ruling is based, because the legal ruling must be based on a correct evaluation of reality. Here the paper looks at the most important aspects of environmental destruction- water, air and soil– and causes due to the extraordinary industrial boom. The paper then discusses the legislation, teachings and moral obligations in the Islamic legislation, which protect the environment destruction and fight it. In fact, this section of the paper cites many legislations from the Qur’an, the prophetic teachings, and the statements of the Muslim jurists related to protecting the environment generally or specifically, whether water, air, plants, animals or the earth. This is furthermore linked to significant legislations related to the concepts of absolute, relative and ameliorative necessities. |
