| Abstract | تحظى قرارات مجمع الفقه الإسلامي بمكانة كبيرة في الاجتهاد المعاصر، حيث ترصد النوازل والقضايا المعاصرة ثم تعرض على لجان علمية قصد بحتها ودراستها ومناقشتها، لمعرفة التكييف الشرعي لها، وتنزيل الأحكام المناسبة، وقد تنوعت مسالك الاجتهاد وطرق الاستدلال على هذه النوازل، ويعتبر القياس من أهم المصادر حضورا أثناء الاستدلال ومناقشة العلماء لتلك القضايا، خاصة فيما يتعلق بالنوازل والمسائل التي لا توجد فيها نصوص صريحة، وقد أخذ تطبيق القياس مجالا أوسع من حيث النظر والاعتبار للمتغيرات والتطورات في البعدين الزماني والمكاني، وكذا الظروف الاجتماعية والتحديات التي تواجه المجتمع المسلم المعاصر وهذا البحث محاولة لتجلية منهج مجمع الفقه الإسلامي والقرارات الصادرة منه المتعلقة بالقياس أو المتأثرة بخططه، في المسائل المختلفة، معتمدا على المنهج التحليلي، وذلك بتكييف المسائل وردها إلى القياس، وانتهاء بالقرار الصادر من المجمع، وقد اتبع الباحث عدة خطوات في دراسة المسائل، يبدأ بتعريف المسألة ثم عرض الأقوال الفقهاء في المسألة، ثم ذكر قرار المجمع الفقهي وأخيرا بيان وجه الاستدلال بالقياس في المسألة، وختاما ذكر الراجح ورأي الباحث كلما أمكن ذلك، وأوصى الباحث بأن قرارات المجمع الفقهي وما يتبعها من نقاش تري حول المستجدات الفقهية لايزال في حاجة إلى مزيد من البحوث المتخصصة، للوقوف على تنوع مجالات الاستدلال بغير القياس، كالاستحسان والمصالح المرسلة والعرف ج ونحوها. |

| Alternative Abstract | The decisions of the Islamic Fiqh Assembly hold great significance in contemporary jurisprudence, where they identify current issues and contemporary challenges, which are then presented to scholarly committees for examination, study, and discussion to determine their legal adaptation and appropriate rulings. The paths of jurisprudence and methods of inference regarding these issues have varied, with analogy being one of the most important sources present during inference and scholars' discussions of these matters, especially concerning issues and matters for which there are no explicit texts. The application of analogy has widened in terms of considering changes and developments in both temporal and spatial dimensions, as well as the social circumstances and challenges facing contemporary Muslim societies. This research aims to elucidate the methodology of the Islamic Fiqh Assembly and its decisions related to analogy or influenced by its schemes, in various matters, relying on an inductive-analytical approach by examining branches, adapting issues, referring them to analogy, and culminating in the decision issued by the Assembly. The researcher followed several steps in studying the issues, beginning with defining the problem, then presenting the opinions of jurists - both classical and contemporary - on the matter, followed by mentioning the decision of the Fiqh Assembly, and finally stating the rationale for inference by analogy in the matter. Lastly, the researcher mentioned the predominant view and their own opinion whenever possible, recommending that the decisions of the Fiqh Assembly and the ensuing rich discussions about jurisprudential developments still require further specialized research to explore the diversity of inference methods beyond analogy, such as consensus, public interest, custom, and the like. |
