| Abstract | : تتناول هذه الدراسة مجموعة من الأسس الشرعية والقواعد الفقهية التي تمهّد عملية الاجتهاد الفقهي في بيان حكم الإغراق السلعي لصوره المتعددة، حيث تسهم بمجموعها في توسيع دائرة الاستدلال على الحكم الشرعي للصور المستجدة في الإغراق السلعي، وتعمل على تدعيم أوجه التخريج الفقهي لهذه الصور على مسألة بعينها من كتب التراث المذهبية. وتكمن مشكلة البحث في صعوبة وقوف الفقيه على مسألة فقهية قديمة تتطابق في تكييفها مع صور الإغراق السلعي المعاصر من كل جهة، مما قد يحمل الفقيه على المغالاة في بعض الأحيان والتكلّف في الحاقها بها، وتسعى الدراسة إلى تعزيز نظر المجتهد في الاستدلال بمجموعة المبادئ الشرعية، والقواعد الفقهية، أو العلل المشتركة التي تعاضد هذا التكييف أو ذاك وتسانده. وبإعمال المنهجين: الاستقرائي والتحليلي استطاعت الدراسة أن تصل إلى نتائجها المرجوة في الحكم بنزول أكثر صور الإغراق السلعي في حكمها تحت المبادئ الفقهية والأسس العامة المانعة من الغش والغبن والغرر، والتي عالجت عقود الاحتكار، وتلقي الركبان، والبيع على البيع، والتحقق من توافقها مع القواعد الفقهية الخمسة المختارة في معالجة موضوع الإغراق السلعي والأحكام المتعلقة به. وأوصت الدراسة بتفعيل منهجية الاستدلال العامة بالأسس الفقهية العامة والقواعد الفقهية والاحتكام إليها عند النظر في المستجدات المالية عموما، والابتعاد عن التكلّف في البحث عن تكييف فقهي خاص لكل صورة مستجدة، أو العناء في إلحاقها بمسألة سبق تناولها في المدونات الفقهية. |

| Alternative Abstract | This study deals with a set of legal foundations and jurisprudential rules that pave the way for the process of jurisprudence in clarifying the ruling on commodity dumping in its various forms. Together, they contribute to expanding the circle of inference on the legal ruling on new forms of commodity dumping, and work to strengthen the aspects of jurisprudential interpretation of these forms on a specific issue of Sectarian heritage books. The problem of the research lies in the difficulty of the jurist in determining an ancient jurisprudential issue that matches in its adaptation to contemporary forms of commodity dumping from every angle, which may force the jurist to exaggerate at times and be arrogant in attaching it to it. The study seeks to enhance the jurisprudence’s consideration in inferring a set of legal principles and rules. Jurisprudence or the common causes that support and support this or that adaptation. By applying the two approaches: inductive and analytical, the study was able to reach its desired results in ruling by ruling most forms of commodity dumping under the jurisprudential principles and general foundations that prevent fraud, injustice, and deception, and treating monopoly contracts, receiving riders, and selling for sale, and their compatibility with the five jurisprudential rules chosen in Addressing the issue of commodity dumping and the provisions related to it. The study recommended activating the general reasoning methodology based on general jurisprudential foundations and jurisprudential rules and resorting to them when considering financial developments in general, and avoiding the effort of searching for a special jurisprudential adaptation for each new image, or bothering to attach it to an issue previously addressed in jurisprudential blogs. |
