| Abstract | الهدف من هذه الدّراسة بيان حقيقة العلاقة بين مفهوم المخالفة وقياس العكس من حيث التّداخل والتّباين، وفق المحاور الآتية: الأوّل: بيان حقيقتهما، لأنّ تحديد العلاقة فرع تصورهما الثّاني: موقف العلماء من اعتبارهما لكونه من مداخل توضيح العلاقة الثّالث: تحديد العلاقة بينهما من حيث التّداخل والتّباين ولمعالجة الموضوع تمّ الدّمج بين المنهج الوصفي والتّحليلي لكفاءتهما في تحقيق أهداف الدّراسة من حيث التّصور والتّحرير فالموازنة، وقد خلص البحث إلى جملة نتائج من أهمها: تحقق التّداخل بين مفهوم المخالفة وقياس العكس من حيث المفهوم والإجراء العملي لإنتاج الأحكام، وأنّ التباين -وإن وجد- فهو اعتباري لا أثر له في إنتاج المطلوب، ومن أهم التوصيات: ضرورة الاهتمام بالكشف عن محالّ التّداخل والتباين في الدّرس الأصولي لوجود مجالات عدة تستدعي النّظر؛ سواء تعلق الأمر بالمصطلحات أم الأدلة أم القواعد البينية؛ صيانة للتّردّد في التّناول ومن ثمّ التّنزيل. |

| Alternative Abstract | The aim of this study is to clarify the relationship between the concept of inconsistency and the measurement of the inverse relationship of overlap and contrast. The study will address the following points: Explaining the true nature of inconsistency and contrast, as understanding their relationship is essential for determining them. Examining the view of the scholars regarding their significance as approaches to understanding the relationship. Identifying the relationship between inconsistency and contrast in terms of overlap and contrast. To discuss the issue, a combination of the descriptive and analytical approaches was used for their effectiveness in achieving the study's objectives in terms of conceptualization, analysis, and balance. The research concluded several important findings, including the confirmation of the relationship between the concept of inconsistency and the measurement of the inverse relationship in terms of both conceptual understanding and practical application for generating judgments. It was also found that contrast, if present, is considered theoretical and does not have an impact on the desired outcome. The key recommendations :The need to focus on identifying areas of overlap and contrast in the fundamental study, as there are several aspects that require attention, whether related to terminology, evidence, or interpretive rules. It is important to maintain a careful approach in addressing these areas and ensure effective implementation. |
