Abstract

The Prophetic hadith of “Women are deficient in Reason and religion” and the problem of Using It as justification in women’s issues, a critical study This research focuses on the problem of Using the Prophetic hadith of “Women are deficient in Reason and religion” in the women’s issues, Among the scholars who consider this text a general Principle from which rulings related to women in all situations and societies are derived, and then rely on it to extent the deficiency of Reason and Religion to all women’s issues, whether those in which the text is mentioned or not. This raises the problem of conflict between the universal principles established by Islamic Sharia regarding the rights of the two elements of humanity, men and women, and the Rules justified by this text. The study shows that the reasoning by this Prophetic Hadeeth in all women’s issues is not correct for many considerations, the most important of which is its conflict with the principle of equality of men and women in the sources of rights and duties, as well as this Method of reasoning is lacking the most important conditions of Analogy, which is that the underlying cause should be consistent and Continual in all cases. It is true in some rulings, but it is not consistent in many other rulings. The research concludes with the importance of consulting context of the Texts, Islamic Maxims and Principles of Islamic Law in understanding the texts in women’s issues, which if adhered to, the Misconceptions and Mistakes could be avoided to a far extent. Key words: deficient in Reason and religion, Reasoning, women’s issues, Rights, Duties. حديث "ناقصات عقل ودين" وإشكالية التعليل به في قضايا المرأة، دراسة نقدية يتناول هذا البحث إشكالية التعليل بحديث ناقصات عقل ودين في قضايا المرأة، فمِن العلماء من اعتبر هذا النص دليلا عاما تستقى منه الأحكام المتعلقة بالمرأة في كل الأوضاع والمجتمعات ومن ثم الاعتماد عليه للحكم بالنقص عليها في إجراء الأحكام مطلقا، سواء تلك التي ورد فيها نص أم لم يرد فيها نص مما يثير إشكالية التعارض بين المبادئ الكلية التي قررتها الشريعة الإسلامية في حق عنصري الإنسانية الرجل والمرأة وبين الأحكام الجزئية المعلّلة بهذا النص. أوضحت الدراسة أن التعليل به في جميع قضايا المرأة لا يستقيم لاعتبارات كثيرة فمن أهمها تعارضه مع مبدأ مساواة الرجل والمرأة في مصدري الحقوق والواجبات فضلا أن التعليل به يفتقد لأهم شروطه، وهو أن تكون العلة مطردة ومنعكسة، والتعليلُ بنقصان العقل والدين في حق المرأة وإن كان يُرى صحيحا في بعض الأحكام فلا يكون مطّردا في كثير من الأحكام الأخرى. وينتهي البحث الى أهمية الاعتماد على السياق والقواعد الكلية والضوابط الأصولية في فهم النصوص الشرعية في قضايا المرأة، وهو الأمر الذي إذا التُزم به سلمت الأفهام والتأويلات عن مختلف التصورات البعيدة عن الدين وتعاليمه الصحيحة. الكلمات المفتاحية:ناقصات عقل ودين،التعليل،قضايا المرأة،الحقوق، الواجبات
