| Abstract | تسعى هذه الدراسة إلى تقييم موقف النسوية تجاه أحكام الأسرة، وتخص بالبحث التيار النسوي الذي يتبنى الانطلاق في موقفه من المرجعية الإسلامية، وذلك بعرض آرائه على القواعد الأصولية، وبيان مدى موافقتها أو مخالفتها لها، وقد استعانت الدراسة بالمنهج الاستقرائي لاستخلاص الآراء والأقوال العامة التي يستند عليها هذا التيار النسوي، ثم صنفتها الدراسة إلى أسس نظرية، ومداخل أصولية، كما استعانت بالمنهج الوصفي التحليلي، لتحليلها وبيان مستندها، واختبار صحتها، ومما خلصت إليه الدراسة؛ أن التيار النسوي على الرغم من دعوته الانتماء للمرجعية الإسلامية، إلا أنه تعارض معها في مواضع بعضها راجع لطريقة تطبيق هذه المرجعية، وبعضها إلى تحديد الإطار المعرفي لها، ومن النتائج أيضًا؛ أن رؤية هذا التيار النسوي لعدد من المداخل الأصولية تتعارض مع مبدأ صلاحية الشريعة ومرجعية نصوصها، وأن رؤيته للاجتهاد على أنه أداة لإحداث التغيير في المدونة الفقهية؛ لإنصاف المرأة، جعلت نقده وآراءه متحيزة وغير موضوعية، وتسعى لتبرير نتائج مسبقة. |

| Alternative Abstract | This study aims to evaluate the feminist stance on family rulings, with a particular focus on the feminist current that claims to derive its position from an Islamic frame of reference. The study analyzes the views of this current in light of the foundational principles of Islamic jurisprudence (uṣūl al-fiqh).to determine the extent to which they conform to or deviate from these principles. The study employed an inductive method to extract the general opinions and assertions underpinning Islamic feminism, subsequently classifying them into theoretical foundations and Uṣūl-based approaches. It also utilized a descriptive-analytical method to analyze these viewpoints, clarify their evidentiary bases, and assess their validity. The study concluded that, although Islamic feminism claims allegiance to the Islamic framework, it diverges from it in several respects some due to the application of this framework and others due to the definition of its epistemological scope. Moreover, its perspective on several Uṣūl approaches conflicts with the principle of the enduring validity of Shariah and the authoritative status of its texts, and its view of ijtihād as a tool to reform the corpus of fiqh in order to achieve justice for women renders its critiques and opinions biased and non-objective, seemingly aimed at justifying predetermined conclusions. |
