Abstract | يعدّ ﺍﻟﻘﺎﻧﻮﻥ ﺃﺩﺍﺓ ﻟﺘﻄﻮﻳﺮ ﺍﻻﺳﺘﺪﺍﻣﺔ ﻭﺗﻌﺰﻳﺰها، ﻣﻦ ﺧﻼﻝ ﺗﻨﻈﻴﻤﻪ ﻟﻤﺴﺘﺠﺪﺍﺕ ﺍﻟﺤﻴﺎﺓ، ﺣﻴﺚ ﻳﻤﻜﻦ ﻣﻦ ﺧﻼﻝ ﻫﺬﻩ ﺍﻟﺘﺸﺮﻳﻌﺎﺕ ﺍﻟﻤﺴﺘﺤﺪﺛﺔ ﺗﺤﻘﻴﻖ ﺍﺳﺘﺪﺍﻣﺔ، ﻻ ﻳﻘﺘﺼﺮ ﺃﺛﺮﻫﺎ ﻋﻠﻰ ﻣﻮﺍﺟﻬﺔ ﺍﻟﻤﺴﺘﺠﺪﺍﺕ ﺍﻟﺮﺍﻫﻨﺔ، ﺇﻧﻤﺎ ﺗﻌﻤﻞ ﻋﻠﻰ ﺗﺮﻙ إﺭﺙٍ مستمرٍّ ﻟﻸﺟﻴﺎﻝ ﺍﻟﻘﺎﺩﻣﺔ. ﻭﻟﻘﺪ ﻛﺎﻥ ﻟﻔﻮﺯ ﻗﻄﺮ ﺑﺘﻨﻈﻴﻢ ﻛﺄﺱ ﺍﻟﻌﺎﻟﻢ ﺃﺛﺮﻩ ﻓﻲ ﺍﺳﺘﻘﺪﺍﻡ ﺁﻻﻑ ﺍﻟﻌﻤﺎﻝ ﺍﻷﺟﺎﻧﺐ، ﻭقد ﻭﺍﻛﺐ ﺫﻟﻚ ﺍﻟﺤﺪﻳﺚ ﻋﻦ ﻣﺪﻯ ﺗﻤﺘﻊ ﺍﻟﻌﻤﺎﻝ ﺍﻷﺟﺎﻧﺐ ﺑﺎﻟﺤﻤﺎﻳﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻓﻲ ﺩﻭﻟﺔ ﻗﻄﺮ، مما ﺍﻧﻌﻜﺲ ﻋﻠﻰ ﺍﻟﺘﺸﺮﻳﻊ ﺍﻟﻘﻄﺮﻱ ﻓﻲ ﻣﺠﺎﻻﺕ ﻋﺪﺓ، ﻣﻦ ﺑﻴﻨﻬﺎ ﺗﻄﻮّﺭ ﺍﻟﺤﻤﺎﻳﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻓﻲ ﻣﺠﺎﻝ ﺣﻘﻮﻕ ﺍﻟﻌﻤﺎﻝ. ﻭقد ﺳﻌﺖ ﺍﻟﺪﺭﺍﺳﺔ ﺇﻟﻰ ﺭﺻﺪ ﻣﻼﻣحه ﻣﻦ ﺧﻼﻝ ﻣﺒﺤﺜﻴﻦ ﺭﺋﻴﺴﻴﻴﻦ، ﺧُﺼِّﺺ ﺍﻟﻤﺒﺤﺚ ﺍﻷﻭﻝ لتطوُّر ﺍﻟﺤﻤﺎﻳﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻓﻲ ﻣﺮﺣﻠﺔ ﻣﺎ ﻗﺒﻞ ﺇﺑﺮﺍﻡ العقد ﺑﻴﻦ ﺍﻟﻌﺎﻣﻞ ﻭربِّ ﺍﻟﻌﻤﻞ، ﻭﺍﻟﻤﺒﺤﺚ ﺍﻟﺜﺎﻧﻲ ﺗﻢ ﻓﻴﻪ ﺩﺭﺍﺳﺔ ﺗﻄﻮُّﺭ ﺍﻟﺤﻤﺎﻳﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﻓﻲ ﻣﺮﺣﻠﺔ ﺗﻨﻔﻴﺬ ﻋﻘﺪ ﺍﻟﻌﻤﻞ. ﻓﻔﻲ ﻣﺮﺣﻠﺔ ﻣﺎ ﻗﺒﻞ ﺇﺑﺮﺍﻡ ﺍﻟﻌﻘﺪ، ﻇﻬﺮﺕ ﻣﻼﻣﺢ ﺍﻟﺘﻄﻮُّﺭ ﻭﻓﻘﺎ ﻟﻠﻘﻮﺍﻋﺪ ﺍﻟﻌﺎﻣﺔ ﻣﻦ ﺧﻼﻝ ﻓﺮﺽ ﺍﻟﺘﺰﺍﻡ ﻋﻠﻰ ﻋﺎﺗﻖ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺑﺎﻹﺩﻻﺀ ﺑﺎﻟﺒﻴﺎﻧﺎﺕ ﻗﺒﻞ ﺍﻟﺘﻌﺎﻗﺪ، ﻛﻤﺎ ﺑﺪﺕ ﻫﺬﻩ ﺍﻟﻤﻼﻣﺢ ﻭﻓﻘﺎ ﻟﻠﻘﻮﺍﻋﺪ ﺍﻟﺨﺎﺻﺔ ﺑﻘﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻣﻦ ﺧﻼﻝ ﺗﻨﻈﻴﻢ ﻣﻜﺎﺗﺐ ﺍﻻﺳﺘﻘﺪﺍﻡ، ﺃﻣﺎ ﻓﻲ ﻣﺮﺣﻠﺔ ﺗﻨﻔﻴﺬ ﺍﻟﻌﻘﺪ، ﻓﻘﺪ ﺗﻢّ ﺍﺳﺘﻌﺮﺍﺽ ﻣﻼﻣﺢ ﺍﻟﺘﻄﻮُّﺭ ﻓﻲ ﺃﻛﺜﺮ ﻣﻦ ﻣﺠﺎﻝ، ﺣﻴﺚ ﺗﻢّ ﺑﺤﺚ ﺗﻄﻮُّﺭ ﺍﻟﺤﻤﺎﻳﺔ ﻓﻲ ﻣﺠﺎﻝ ﺍﻟﺼﺤﺔ، ﻭﻓﻰ ﻣﺠﺎﻝ ﺍﻟﺤﻤﺎﻳﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ، ﻭﻓﻰ ﻣﺠﺎﻝ ﺣﻤﺎﻳﺔ ﺍﻷﺟﺮ، ﻭﺃﺧﻴﺮًا ﻓﻲ ﻣﺠﺎﻝ ﺣﻤﺎﻳﺔ ﺣﻘﻮﻕ ﺍﻹﻧﺴﺎﻥ، ﻭﺫﻟﻚ ﻣﻦ ﺧﻼﻝ ﺷﺮﺡ ﻧﺼﻮﺹ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﺍﻟﻘﻄﺮﻱ وتحليلها، ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﺘﻌﺎﻗﺒﺔ ﺍﻟﺘﻰ ﺻﺪﺭﺕ ﺗﻨﻔﻴﺬﺍ ﻟﻪ، ﻭﻛﺬﻟﻚ ﺍﻟﺘﺸﺮﻳﻌﺎﺕ ﺫﺍﺕ ﺍﻟﺼﻠﺔ، ﻛﺎﻟﻘﺎﻧﻮﻥ ﺭﻗﻢ 12 ﻟﺴﻨﺔ 2015 ﺑﺸﺄﻥ ﺗﻨﻈﻴﻢ ﺩﺧﻮﻝ ﺍﻟﻮﺍﻓﺪﻳﻦ وخروجهم. |

Alternative Abstract | The law is a tool for the development and promotion of sustainability through its organization of the latest developments in life. These new legislative enactments can achieve sustainability not only to confront the current developments, but also to leave a legacy for future generations. Qatar’s success in organizing the World Cup has had an impact on bringing in thousands of foreign workers besides the extent to which foreign workers enjoy legal protection in Qatar. This study examined the development of legal protection in the field of workers’ rights. The study sought to monitor the development of the legal protection of workers’ rights through two main topics. The first section deals with the development of legal protection in the period prior to the conclusion of the employment contract between the worker and his employer, and the second section examines the evolution of legal protection in the implementation phase of labor contract. In the pre-contract phase, the development features appeared in accordance with the general rules by imposing an obligation on the employer to make statements prior to the contract, in accordance with the rules of the Labor Law regarding the organization of recruitment agencies. Many development aspects in various fields have been discussed during the implementation phase of the contract – the field of health, social protection of wages, and protection of human rights. This has been achieved through the explanation and analysis of the provisions of the Qatari Labor Law and successive issued ministerial decisions as well as legislation No. 21 of 2015 on regulating the entry and exit of expatriates. |
