| Abstract | تقدّم هذه الدراسة تحليلاً لبنية عقود بطاقات الاتصال "هلا" مسبقة الدّفع التي تقدمها شركة "أريد" (Ooredoo)؛ للتعرّف على شروط وأنواع الخدمات المندرجة تحت هذا النوع من البطاقات، وللتوصل إلى بيان التكييف الفقهي للعقد الناظم لها. تبرز أهمية البحث من الانتشار الواسع لخدمات الاتصالات ذات الدّفع المسبق، وتعدد صور الخدمات المقدمة ضمن بطاقات "هلا" مسبقة الدّفع، ذات الانتشار الواسع بين مستخدمي شركة "أريد" عبر البلدان الإسلامية. اعتمدت الدراسة المنهجين الوصفي والتحليلي لتقييم عقود خدمات بطاقات "هلا" مسبقة الدّفع بعد مقارنة أنواعها وتمييز شروطها. أظهرت النتائج أن عقود بطاقات "هلا" مسبقة الدّفع عقود مركبة، والحكم عليها يؤول إلى الإباحة بالنظر إلى ما اشتبهت به من عقود مسماة، وانتفاء ما يوجب نهي الشارع في بنيتها. توصي الدراسة بتوسيع نطاق البحوث المتعلقة ببطاقات الدّفع المسبق، وإجراء بحوث معمقة حول الإرادة التعاقدية للمستخدمين وتأثير الأساليب الترويجية عليها، وتعزيز الرؤية الشرعية للجزاءات والتعويضات المستحقة للمستخدمين في ظل غلبة عقود الإذعان على هذا النوع من المعاملات. |

| Alternative Abstract | This study analyzes the contractual structure of "Hala" prepaid communication cards offered by “Ooredoo”, aiming to identify the terms and types of services included under these cards, and to determine the juristic adaptation of the governing contract. The significance of the study emerges from the widespread use of prepaid telecommunication services and the variety of services provided through "Hala" prepaid cards, which are popular among “Ooredoo” users across Islamic countries. The study adopted descriptive and analytical methodologies to evaluate the service contracts of "Hala" prepaid cards by comparing their types and distinguishing their terms. The study concluded that "Hala" prepaid card contracts are composite contracts, and their ruling leads to permissibility, considering their resemblance to nominal contracts and the absence of any prohibitive elements in their structure. The study recommends expanding research on prepaid cards, conducting in-depth studies on users’ contractual intent and the impact of promotional methods on their decision-making, and enhancing the Shari’ah perspective on penalties and compensations for users, considering the dominance of adhesion contracts in such transactions. |
