| Abstract | تناولت الدراسة موضوعا مهما عن فهم أعمق للخطابات الشرعية أمرًا ونهيا وخبرا، فبينت معنى المصطلحين أعلى معنى وأدنى معنى مع ذكر الأمثلة، وبينت خلاف العلماء في ذلك والراجح من أقوالهم، ودرست العلاقة بين القاعدة ودلالة المطلق والمقيد من ناحية، ودلالة الأمر والنهي من ناحية أخرى حتى تنزل الدلالة منزلتها بين الدلالات الأخرى، وتميزت الدراسة عن الدراسات السابقة بتأصيل أدلة الدلالة وبيان علاقاتها بالدلالات الأخرى، وكشفت عن أوجه تطبيقها من خلال الأمثلة التي ذكرتها، وإشكاليتها الكبرى بيان دلالة اللفظ بين أعلى معنى له وأدناه في الدلالات الأصولية، واعتمدت الدراسة المنهج الاستقرائي في جمع المعلومات، والمنهج التحليلي في مناقشتها، وخلصت إلى أن ذمة المكلف تبرأ بأداء أقل ما يصدق عليه اللفظ في الأمر، وتبرأ بالإحجام عن جميع المنهي عنه في النهي بما يشمل أعلى معانيه وأدناها إلا لقرينة في الحالتين كلتيهما. |

| Alternative Abstract | This study deals with an important topic, which focuses on a deeper understanding of Islamic discourses, command, proscription, and predicate. The study was able to clarify the definition of the two terms: Complete and deficient meaning of a word with examples and explain the different views of scholars on it and the most correct opinion from my point of view. The Research also elaborated the connection between the Principle Meaning of a word and the implication of the common (Mutlaq) and confined (Muqaiyyad) word and on the other hand, the connection between the implication of the command (Amr) and proscription (Nahy) in order to decide the correct meaning. This study is distinguished and different from previous studies by rooting the concept of implication and explaining its relations to other implications, exploring aspects of its application through the examples. The research problem revolves around the impact of the complete and deficient meaning of a word in the jurisprudential semantics. The study adopted the inductive approach in collecting information and data, And the analytical approach in analyzing and discussing it, and concluded that the Responsibility of the legal Capable (Mukallaf) is absolved by performing the least applicable meaning in the Command (Amr), and absolved by abstaining from all that is forbidden in the proscription (Nahy) except for a presumption in both cases. |
