دور البحث العلمي في معالجة قضية المعاهدين - دراسة قرآنية

| الملخص | يتناول هذا البحث دراسة موضوع المعاهدات الدولية وبالأخص تتناول موضوع البحث العلمي في القرآن الكريم ودوره في معالجة قضية المعاهدين في الإسلام والأطرافِ الذين يحقُ للمسلمين موادعتهُم والتعاملُ معه، لكون القرآن الكريم المرجع الأصيل في بيان تلك العلاقات. وعليه تهدف هذه الورقة لتسليط الضوء على أهمية البحث العلمي في مجال السياسة الشرعية ودوره في معالجةِ قضية المعاهدين في الإسلام. ثم أن هذه الورقة لا تتناول هذا الموضوع من حيث عمومِ صورها الواقعيةِ أو عمومِ أطرافها، بل من حيث كونها نتيجةً للرؤيةِ الإسلاميةِ للاجتماع الإنساني السياسي الإسلامي تأثيرًا وتأثرًا. سؤال رئيس: ما المنهج القرآني في التعامل مع المعاهدين وما أصنافهم؟ وذلك من خلال اتباع الدراسة لمنهجين رئيسيين هما: المنهج الاستقرائي، والمنهج التحليلي من خلال تفسير واستنباط المفاهيم والأحكام. وقد خلصت الدراسة إلى عدد من النتائج، عناية الإسلام بقضية المعاهدين وشمولية آيات القرآن الكريم، كذلك خرج البحث إلى بيان أن العلاقة بين مفهوم المعاهدة والمهادنة علاقة تباين. |

| الملخص البديل | This research deals with the study of the issue of international treaties, and it deals with the topic of scientific research in the Noble Qur’an and its role in addressing the issue of treaties in Islam and the parties that Muslims have the right to deal with; this is because the Holy Qur’an is the original reference in clarifying those relationships. Accordingly, this paper aims to shed the light on the importance of scientific research in the field of legitimate policy (Al-Siyasah al-Shar'iyah) and its role in addressing the issue of treaties in Islam. Moreover, this paper does not deal with this topic in terms of its general realistic forms or its general parties, but rather in terms of being an outcome of the Islamic vision of the Islamic political and humane meeting, in terms of influencing it and being affected by it. a major question: What is the Qur’anic approach to dealing with treaties and what are their classifications? And that is through the study of two main approaches: the inductive approach, and the analytical approach. The study concluded a number of results, the concern of Islam with the issue of the treaties and the comprehensiveness of the verses of the Noble Qur’an. The research also came out to show that the relationship between the treaty and the appeasement is a relationship of contrast. |
