| Abstract | تبحث هذه الدراسة في مفهوم المقاصد الشرعية وكيف ظهرت بوضوح في أفعال النبي ﷺ، سواء في وقت السلم أو الحرب، وذلك لترسيخ هذا المفهوم الأساس في الفقه الإسلامي، وتقديم تحليل عميق لكيفية تطبيق النبي ﷺ لهذه المقاصد في حياته، مما يعطينا فهمًا أعمق للأهداف الكامنة وراء التشريع الإسلامي. تقوم هذه الدراسة على المنهج التحليلي والاستقرائي، من خلال تعريف المقاصد الشرعية، وتصنيفاتها، وأصولها، بالاعتماد على آراء كبار علماء الأصول، مع تتبع دقيق لتصرفات النبي ﷺ في سياق السلم، ليظهر جلياًّ كيف برزت مقاصد حفظ الضروريات الخمس (الدين، النفس، العقل، النسل، المال) في أقواله وأفعاله لبناء مجتمع مستقر، مروراً بتحليل تصرفاته ﷺ في سياق الحرب، وذلك لإبراز الأهداف المقاصدية في الدفاع عن الدين والأمة ورد الظلم، مع التزامه الشديد ﷺ بالأخلاق في السياقين. وتُختتم الدراسة بمقارنةٍ بين المقاصد في سياقَي السلم والحرب، لتوضيح الفروق والتقاطعات بينهما، لتؤكد النتائج أن المقاصد الشرعية هي جوهر التشريع وروحه، وأن فهمها الدقيق ضروري لتطبيق سنة النبي ﷺ بمرونة وواقعية تتناسب مع تحديات العصر الحديث، مما يعزز قدرة الشريعة على التفاعل الإيجابي مع المستجدات. |

| Alternative Abstract | This study examines the concept of Maqasid al-Shari'ah (objectives of Islamic law) and how they clearly manifested in the actions of Prophet Muhammad ﷺ, both in times of peace and war. Our aim is to solidify this fundamental concept in Islamic jurisprudence and provide an in-depth analysis of how the Prophet ﷺ applied these objectives in his life, giving us a deeper understanding of the underlying goals of Islamic legislation. We adopted an analytical and inductive methodology for this study. We began by defining Maqasid al-Shari'ah, its classifications, and origins, relying on the views of prominent classical scholars. Subsequently, we meticulously traced the Prophet's ﷺ actions in the context of peace, illustrating how the objectives of preserving the five necessities (religion, life, intellect, progeny, and wealth) were evident in his sayings and deeds for building a stable society. Conversely, we analyzed his actions ﷺ in the context of war, highlighting the Maqasid-oriented goals of defending faith and the nation, and repelling injustice, while strictly adhering to ethical principles. The study concludes with a comparison between the Maqasid in both contexts of peace and war, clarifying their differences and intersections. The findings confirm that Maqasid al-Shari'ah are the essence and spirit of the legislation, and their precise understanding is crucial for applying the Prophet's ﷺ Sunnah with flexibility and realism to suit the challenges of the modern era, thereby enhancing the Sharia's ability to engage with contemporary developments positively |
