| Abstract | يعتبر نظام الفصل العنصريّ الذي شهدته جنوب أفريقيا، والذي ما زالت تشهده فلسطين، أشد أنظمة الفصل العنصريّ وأكثرها استبدادًا، فالأفريقيون هم أصحاب الأرض المضطهدون على أرضهم من قبل المستوطنين البيض، كذلك الأمر في فلسطين حيث مارست إسرائيل ولا تزال أبشع سياسات وقوانين التمييز العنصريّ ضد الشعب الفلسطيني الذي له الأحقية بأرضه. انتهت قضية التمييز العنصريّ في جنوب أفريقيا، والتي استمرت لأكثر من خمسين عامًا، نتيجةً للاهتمام الكبير الذي حظيت به من قبل الأمم المتحدة، ونتيجة العقوبات التي فرضت من قبل المجتمع الدولي. أمَّا الاحتلال الإسرائيلي لفلسطين فما زال مستمرًا رغم كافة المحاولات لإنهائه. لذلك تسعى الدراسة للإجابة على سؤال محوري هو: ما وضعية التمييز العنصريّ في فلسطين ومقارنته بجنوب أفريقيا في ضوء القانون الدولي والشرعية الدولية بعهودها وقراراتها ومواثيقها؟ |

| Alternative Abstract | The Apartheid regime witnessed in South Africa and currently witnessed in Palestine is one of the most oppressive and despotic regimes. The African citizens were oppressed on their land by the white settlers, and in Palestine, Israel has also imposed the most egregious policies and laws of racial discrimination against the Palestinian people to whom the land actually belongs. The issue of racial discrimination in South Africa, which lasted for more than 50 years, has ended because of the great attention given to it by the United Nations and the sanctions imposed by the international community. However, the Israeli occupation of Palestine continues despite all attempts to end it. This study aims to clarify the status of racial discrimination in Palestine and to compare it to South Africa’s issue, based on international law and international legitimacy with its promises, resolutions and charters. |
