| Abstract | تُعدُّ مسألة مشروعية استعمال القوة في العلاقات الدولية من أكثر المسائل إشكالًا عبر التاريخ، حيث اختلفت محددات مشروعية استعمالها باختلاف الأديان والثقافات والأزمنة والأمكنة. وفي العصر الحديث استقر النظام الدولي على معايير واضحة لمشروعية استعمال القوة، بحيث تتخلّف تلك المشروعية بتخلّف تلك المعايير، وتوجد بوجودها. في مقابل هذا الاستقرار في القانون الدولي؛ نجد أن الجدل الفقهي ما يزال مستمرًّا حول معايير مشروعية استعمال القوة، ولا شك أن هناك اختلافًا ظاهرًا وكبيرًا بين الطرح الفقهي التاريخي والطرح المعاصر. في هذه الورقة تم تناول استعمال القوة وتوظيفها في القانون الدولي؛ بحثًا عن جوابٍ لسؤال الشرعية، ثم قورنت المقاربة القانونية بالمقاربة الشرعية النصية. بدأ البحث بالحديث عن مفهوم القوة في القانون، وفي النص الإسلامي، ثم انتقل لمناقشة مشروعية استعمال القوة من المنظور القانوني وموقف النص الإسلامي من المشروعية القانونية. كما سعى البحث لدراسة الموقف الإسلامي من استعمال القوة، وعلى ماذا تتكئ في مشروعيتها من خلال دراسة النص الإسلامي. |

| Alternative Abstract | The legality of using power in international relations is one of the most controversial issues throughout history. The determinants of the legality of using power vary according to religions, cultures, and contest. In modern times, the international system finally agreed to create clear standards for the legality of using power. Therefore, this legality is applicable or not whenever these standards are available or not. In comparison with the stability of international law to this legality, we find that Islamic jurisprudence is still debating it. Undoubtedly, there is a significant and clear difference between the past and modern views of Islamic jurisprudence. In this research paper, the use and application of power in international law have been addressed in an attempt to answer the question of legality. Then the legal approach was compared to the texts of Islamic law. The research paper begins with the subject of power in law and Islamic texts. Then it moves to a discussion of the legality of using power from the perspective of law and the opinions of Islamic texts on this legality. The research paper also attempts to analyze Islamic attitudes towards the use of power and the justifications of this use through the study of Islamic texts. |
