| Abstract | إنّ من أعمال المناهج الغربية ظاهرة "نقد النصوص"، والتي أسقطها العلمانيون والحداثيون على النصوص الشرعية، واستُغلّ مصطلح التأويل لكونه مصطلحاً إسلامياً كمدخل إلى هذه المنهجية، بحجة إعادة قراءة النص الشرعي قراءة جديدة امتدت إلى الأصول الثابتة، والمفاهيم المستقرة والمعلومة من الدين بالضرورة، لتجعل منها أفكاراً نسبية خاضعة للتجديد والتغيير والمعاصَرة. والجدير بالذكر أنّ هذه الدعوى قد سبق وتبنّاها فلاسفة التنوير الغربي الوضعي العلماني بالنسبة للتوراة والإنجيل؛ فرأوا أن نصوصهما إنما تمثل مرحلة تاريخية، ولم تعُد صالحة لعصر العلم، وهذه هي مشكلة البحث وعليه؛ فقد هدف البحث إلى بيان ونقد نظرية التاريخية؛ التي يستعملها الحداثيون والنسويات في تأويل النصوص الشرعية، وما يترتّب على هذه المنهجية من تغيير وتبديل وتحريف في النص القرآني ومراد الله منه. سيعتمد البحث على المنهج الوصفي الذي يقوم على الدراسة النظرية والمكتبية. من أهم النتائج البحث وهو أن الشريعة الإسلامية صالحة لكل المجتمعات والأزمنة غير مقتصرة على مرحلة تاريخية. |

| Alternative Abstract | Onework of the Western approaches is the phenomenon of “Text Criticism”, which was utilized by the secularists and modernists on the texts of legitimacy. Being an Islamic term, the term interpretation was used as an approach to this methodology on thepretext of re-reading the legal text in a new way which extends to the fixed sources and stable concepts of religion to make them relative ideas subject to renewal, change and modernism. It is worth mentioning that this case has been adopted earlier by the philosophers of the man-made Secular Western Enlightenment for the Torah and the Bible; they saw their texts represent a historical stage and no longer valid for the age of science, and this is the statement of the research problem. Therefore, this studyaims to identify, refute and criticize the historical theory used by modernists and feminists for the interpretation of the legitimacy texts and the consequences of such methodology in changing, altering and distorting of the Quranic texts and their actual meanings. The research is based on a descriptive approach which depends upon a theoretical study. One of the most important findings of this study is that Islamic legitimacy is valid for all societies and times and not restricted to a specific historicalstage. |
