| الملخص | يتمتع الوزير في النظام السياسي القطري بمكانة مرموقة، وهو يجمع بين يديه السلطة الإدارية والسلطة السياسية، ونظرا لاتساع السلطات التي يمارسها الوزير، فلا بد من أن يكون مسؤولاً عن أفعاله، عملاً بمبدأ (التلازم بين السلطة والمسؤولية)، ولذلك فقد نص الدستور القطري لعام 2004 على المسؤولية السياسية والمسؤولية الجنائية للوزراء، وذلك لضمان عدم انحرافهم عن تحقيق الصالح العام، ومحاسبتهم إذا ما ارتكبوا جرائم أو أخطاء. وتثور المسؤولية الجنائية للوزراء عندما يرتكبون إحدى الجرائم المعاقب عليها في قانون العقوبات أو القوانين الجنائية، أو قانون محاكمة الوزراء في الدول التي يوجد فيها مثل هذا القانون، وقد كانت مساءلة الوزراء في دولة قطر فيما يتعلق بالجرائم المرتبطة بوظائفهم، تخضع لأحكام الفصل الخامس من القانون رقم ( 21 ) لسنة 2004 بشأن الوزراء، حيث كان هذا الفصل يحدد الجرائم المرتبطة بوظائف الوزراء، كما كانت محاكمتهم تتم وفقاً للإجراءات الجنائية المنصوص عليها في الفصل نفسه ، أما الجرائم التي يرتكبونها كأفراد عاديين، فقد كانت تتم محاكمتهم عليها وفقاً لقانون الإجراءات الجنائية القطري رقم ( 23 ) لسنة 2004 . أما بعد صدور القانون رقم ( 3 ) لسنة 2021 فقد تم إلغاء الفصل الخامس المشار إليه أعلاه، وقد أصبحت محاكمة الوزراء على جميع الجرائم تتم وفقاً لقانون الإجراءات الجنائية القطري رقم ( 23 ) لسنة 2004 ، بخلاف ما عليه الحال في بعض الأنظمة السياسية التي تجعل محاكمة الوزراء من اختصاص السلطة التشريعية ، أو من اختصاص هيئة مختلطة. وتأتي هذه الدراسة التي اتبع الباحث فيها المنهج التحليلي المقارن، لدراسة الأحكام الموضوعية والأحكام الإجرائية لمحاكمة الوزراء، وتحديد مدى نجاح النموذج المتبع في دولة قطر في محاكمة الوزراء، إذا ما قورن مع النماذج السائدة في بعض النظم السياسية المعاصرة، وقد توصل الباحث في ختام هذه الدراسة إلى مجموعة من النتائج والتوصيات. |

| الملخص البديل | In the Qatari political system, the minister enjoys a prominent position, and he combines in his hands the administrative and political authority, and given the wide powers exercised by the minister, he must be responsible for his actions, pursuant to the principle of (the interdependence between authority and responsibility), and therefore the Qatari Constitution of 2004 stipulated On the political and criminal responsibility of ministers, to ensure that they do not deviate from the realization of the public interest, and to hold them accountable if they commit crimes or mistakes. The criminal responsibility of ministers arises when they commit one of the crimes punishable in the penal code or criminal laws, or the law on the trial of ministers in the countries where such a law exists, and the accountability of ministers in the State of Qatar with regard to crimes related to their jobs was subject to the provisions of Chapter Five of Law No. (21) for the year 2004 regarding ministers, as this chapter defines crimes related to the functions of ministers, and their trial was carried out in accordance with the criminal procedures stipulated in the same chapter. As for the crimes they committed as private individuals, they were tried according to the Qatari Criminal Procedures Law No. (23) for the year 2004. After the issuance of Law No. (3) of 2021, the fifth chapter referred to above was abolished, and the trial of ministers for all crimes is carried out in accordance with the Qatari Criminal Procedure Law No. 23 of 2004, unlike the case in some political systems that make trial Ministers fall under the jurisdiction of the legislature or of a mixed body. This study, in which the researcher followed the comparative analytical method, came to study the substantive and procedural provisions for the trial of ministers, and to determine the extent of the success of the model followed in the State of Qatar in the trial of ministers if compared with the prevailing models in some contemporary political systems.
