| Abstract | أهداف البحث: يهدف هذا البحث إلى بيان فكرةٍ جديدةٍ لمْ يتناولْها أحدٌ- فيما أعلم - بدراسةٍ مستقلةٍ، وهي «المقاصدُ النفسيةُ في الأحكامِ الشرعيةِ»، وقد قمت بدراسةٍ تطبيقيةٍ على (جبر الخواطر)، وكان الغرض من البحث بيان أنَّ الشريعة راعتْ في أحكامها النفسَ البشريةَ، وما يجبرها حالة انكسارها، وما يحفِّزها لامتثال أحكامها؛ حبًّا لخالقها، ورضًا بما شرع. منهج الدراسة: تقتضي طبيعة البحث تعدد المناهج؛ ولذلك فإن الباحث جمع في هذه الدراسة بين الاستقراء وتحليل النصوص؛ أما المنهج الاستقرائي: ففي تتبع الآيات القرآنية في السور المتعلقة بموضوع البحث، وأما المنهج التحليلي: ففي تحليل النصوص المستقرأة، والوقوف على المعاني الدقيقة التي تحتملها، ولها علاقة وثيقة بموضوع البحث. النتائج: توصل البحث إلى جملة من النتائج يمكن إيجازها فيما يلي: الأحكام بما فيها من تحقيق المصالح ودرء المفاسد؛ أثر من آثار أسماء الله الحُسنى وصفاته العليا. راعت الشريعة الإسلامية ميول النفوس البشرية ومشاعرها خاصة المنكسرة قلوبهم؛ لتحثها على الامتثال والانقياد. أصالة البحث: يعدّ البحث لبنة في الدراسات النفسية للأحكام الشرعية؛ تقدّم أنموذجًا يسترشد به الباحثون الراغبون في إكمال الفكرة وإتمامها؛ ومن وحيها يوصي الباحث بالدراسات المستقبلية التالية: القيام بدراسةٍ علميةٍ موسعةٍ بعنوان «آياتُ الأحكامِ دراسةٌ نفسيةٌ»، أو «المقاصدُ النفسيةُ في الأحكامِ الشرعيةِ» أنْ يتبنَّى مركزٌ منْ مراكزِ الدراساتِ القرآنيةِ أو قسمٌ منْ أقسامِ التفسيرِ وعلومِ القرآنِ - بالتعاونِ معَ مختصَّينَ في علمِ النفسِ - إعدادَ تفسيرٍ بعنوانِ «التفسيرُ النفسيُّ للقرآنِ الكريمِ». |

| Alternative Abstract | Purpose: This research aims to study the psychological objectives in Sharia law, which, to the best of my knowledge, is an under-researched topic. I carried out an applied study on the concept of solace with the aim of showing that the Sharia, in its rulings, has given due consideration to the human soul and what comforts, and motivates it to comply with its rulings, out of love for its Creator and in agreement with what has been ordained. Methodology: The nature of the research requires the use of a variety of methods, and therefore, the researcher combined the inductive and analytical methods. While the inductive method was used in surveying the relevant Quranic verses, the analytical method was employed in the analysis of the texts and a scrutiny of its possible meanings relevant to the research topic. Findings: Rulings based on the principles of securing benefits and preventing evil is one of the outcomes of the beautiful names of Allah and His supreme attributes. Psychological factors were taken into account in the rulings relating to women, which are in harmony with the psychological make-up of women. Islamic law also took into consideration the psychological tendencies and feelings of human souls in order to urge them to compliance. Originality: This research is one of the building blocks of the psychological studies for legal rulings. The researcher presents a model that will guide researchers who wish to explore the ideas further. Hence, the researcher recommends the following suggestions for future studies: Conducting an in-depth scientific study entitled “verses of rulings: a psychological study” or “Psychological objectives of the Sharia Law”. That a Qur’anic studies or a Tafsir department should work towards writing a tafsir entitled “The psychological interpretation of the Holy Qur’an”. |
