| الملخص | يعتبر مرض الإيدز من أشد الأمراض العصرية فتكا في البشرية في هذا الزمان ولا تكاد تخلو دولة من شره، حتى إنه قد غزا بلادنا الإسلامية، وينبني على هذا العديد من الأحكام الشرعية والاجتماعية. وقد تناولنا في هذا البحث أثر هذا المرض إذا حصل بأحد الزوجين على عقد الزوجية، من حيث استمرار الحياة الزوجية أو انحلالها. ومع أن هذا المرض لم يتناوله فقهاؤنا الأجلاء في كتبهم : حيث لم يكن معروفا عندهم: إلا أنهم تطرقوا إلى أمراض كانت معروفة في عصرهم وبنوا عليها أحكامهم. ومن هنا قانت أهمية هذا المبحث في الربط بين أقوال الفقهاء الأقدمين في الأمراض .التي عاصروها، مع تنزيل أقوالهم واجتهاداتهم على هذا المرض العصري. لذا تطرق البحث إلى الأمراض القديمة وأنواعها التي تناولها فقهاؤنا، مع طرح فكرة عن مرض الإيدز وطرق انتشاره، ومن ثم بيان مذاهب الفقهاء وأدلتهم مع تخويج الحكم الشرعي على أثر مرض الإيدز على عقد الزوجية بناء على اجتهادات الفقهاء، وبيان الراجح منها. |

| الملخص البديل | AIDS is considered the most severe sickness that kills people in our times, and had spread in almost each country in the world, even in our Islamic countries, where many of the Social and Sharia rules are built on. This research has discussed the impact of Aids o.n marriage if it happens between any of the spouses, of continuing the married life or making the divorse. Although our Scholars haven't discussed this disease in our books, for it wasn't known to them by that time, but have discussed other diseases that were familiar to them and have built there rules accordingly. The importance of this research appeared here by taking the old scholars sayings of the disease that were familiar to them, and applying their opinions to this modem disease.
