الجينوم البشري وأحكامه في الفقه الإسلامي : رؤية مقاصدية

| Abstract | يتناول البحث أحكام الجينوم البشري الذي يعد من الموضوعات الحيوية التي تكثر حاجات الناس إليه اليوم و لاسيما في عالم البيولوجيا، مما ألزم استجلاء الرأي الفقهي الرصين المؤسس على الوسطية الإسلامية، والرؤية المقاصدية الوازنة. فتناولت حقيقة الجينوم البشري المندرج ضمن التقنيات والوسائل العلمية الحديثة للتحكم في الجينات، وبينت المصطلحات ذات العلاقة، ومقاصد الجينوم، وحكم استخدام الجينوم البشري بغرض الوقاية، وكذا المسح الوراثي والاطلاع على الجينوم، كما تناولت حكم استخدام الجينوم البشري لتغيير الخصائص الوراثية مع الاحتراز من محاذير التحكم في الهوية الوراثية، وبيان بحالات الاستفادة من البصمة الوراثية كإثبات النسب مع الاحتياط الشديد في تأمين العملية، وحكم استخدام الجينوم في زرع مكون حيواني في جسم الانسان؛ وحكم زرع مكون خنزيري. وعرجت على حكم استخدام الجينوم في إسقاط الجنين المشوه، مع بيان وجهات النظر الفقهية المختلفة قبل نفخ الروح وبعده، وتناولت حكم الجينوم لأغراض اقتصادية مشبوهة وحظرها شرعا، وكللت البحث برصد ضوابط استخدام الجينوم البشري للأغراض النافعة. والله من وراء القصد |

| Alternative Abstract | The research addresses issues of the human genome •which is related to the needs of people today •particularly in the world of biology •that prompted me to elucidate the Islamic Juridical opinion on these issues •based on Islamic moderation and Purposes of islamic Sharia. I have studied in this research the human genome pertaining to the techniques and modem means used in the controlling genes. I have explained the rule of Islamic Sharia on use of the human genome to change the genetic characteristics with the precautionary measures to control of genetic identity • The research examined the rule of implanting the animal component in the human body• As well as the rule of use of the genome in aborting deformed fetus before or after blowing the soul •and concluded with laying down the criteria of legitimized using of human genome for the useful purposes. |
