| Abstract | هدفت هذه الرسالة إلى تسليط الضوء على أهمية تفعيل الرقابة البرلمانية على الهيئات والمؤسسات العامة في التشريع القطري ومعرفة الإشكاليات التي تحول دون الرقابة البرلمانية أو تضعفها، وعقد مقارنات في موضوع الدراسة بين التشريع القطري والتشريعين المصري والكويتي واقتراح الحلول المناسبة لمعالجة الإشكاليات، وذلك بمبحث أول تناولنا فيه النظام القانوني للهيئات والمؤسسات العامة في دولة قطر، ثم استعرضنا في مبحثٍ ثانٍ الدور الرقابي لمجلس الشورى على أعمال الهيئات والمؤسسات العامة. وقد توصلنا في نهاية الرسالة إلى ان المشرع القطري مَيز في قانون النظام المالي للدولة بين الهيئات والمؤسسات العامة بمعيار استهداف الربح أو معيارٍ اقتصادي، ومنح الهيئات والمؤسسات العامة الشخصية الاعتبارية المستقلة. وفي ذات السياق تتشابه دساتير الدول المقارنة مع دستور دولة قطر في بعض أدوات الرقابة البرلمانية وهي إبداء الرغبات والسؤال والاستجواب وطرح الثقة، وتتعدد الأدوات التشريعية الخاصة بإنشاء وتنظيم الهيئات والمؤسسات العامة في الواقع العملي في دولة قطر. وفيما يخص الرقابة البرلمانية توصلنا إلى وجود هيئات أو مؤسسات عامة لا يمكن إخضاعها للرقابة البرلمانية في دولة قطر لكونها لا تتبع أي وزير، ووجود هيئات ومؤسسات عامة تخضع لرقابة مجلس الشورى لكون المشرع نص على تبعيتها لوزير. وتوصي الرسالة بإصدار قانون جديد للهيئات والمؤسسات العامة، يستند إليه عند قيام السلطة التنفيذية بإنشاء أية هيئة أو مؤسسة عامة. وأن يشتمل هذا القانون على الأحكام العامة، وإلحاق الهيئات والمؤسسات العامة الحالية بالوزير الأقرب إلى نشاطها. |

| Alternative Abstract | This Thesis aimed to shedding light on the importance of activating parliamentary scrutiny over public authorities and institutions in Qatari legislation system, as well as recognizing the obstacles/problems that may hinder or weaken the parliamentary scrutiny. Additionally, it held comparisons between the Qatari, Kuwaiti and Egyptian Legislation Systems and suggested appropriate solutions to address these obstacles/problems. In the first research, we discussed the legal system of public authorities and institutions in Qatar then in the second one, we referred to the scrutiny role of the Shura Council on the work of public authorities and institutions. We reached at the end of this thesis that, the Qatari legislator distinguished within the frame of the State Financial System Law between public authorities and institutions as per a profit-targeting criterion or an economic criterion, in the meanwhile, he granted the public authorities and institutions separate legal personality. In the same context, the constitutions of the comparative countries are similar to the Qatari Constitution in some parliamentary scrutiny tools, namely, expressing desires, questions, and inquiries and asking for confidence. The legislative tools varied in relation to establishing and organizing public authorities and institutions practically in Qatar. In regard to the parliament scrutiny, we founded that there are public authorities and institutions that cannot be subjected to parliament scrutiny in Qatar because of the fact that they are not related to any minister, as well as, at the same time there are public authorities and institutions that are subject to the Shura Council because the legislator stipulated that, they are related to a minister. This Thesis recommends the issuance of a new law for public authorities and institutions to be based upon when the executive authority establishes any public authority or institution. This law shall include the General Provisions and attaching the current public authorities and institutions to the minster nearest to their activities |
