حقوق المرأة في دولة قطر وفق تقرير منظمة هيومن رايتس ووتش: دراسة تقويمية في ضوء الشريعة الإسلامية

| Abstract | تهدف هذه الدراسة إلى تقويم تقرير منظمة هيومن رايتس ووتش المتعلق بحقوق المرأة في دولة قطر في ضوء الشريعة الإسلاميَّة، وتناولت الدراسة إبراز اختلاف المرجعية في تقرير حقوق المرأة بين الإسلام والمنظمات الحقوقية؛ مما يترتب عليه آثارٌ عملية في اعتبار الحقوق وعدمه، وإبراز تمتع المرأة بالمساواة مع الرجل في الحقوق والواجبات في الشريعة الإسلامية، ودحض الشبهات والاتهامات الموجهة لحقوق المرأة في دولة قطر ؛ وذلك باستخدام المنهج التحليلي، والمنهج المقارن. وقد توصلت الباحثة إلى عدد من النتائج أهمها أ- يرجعُ مصدر الحقوق في الشريعة الإسلامية إلى الله -عز وجل- القائمة على الإنسانية، أما بالنسبة إلى المنظمات الحقوقية؛ فَإِنَّ أساس الحقوق لديهم هو النظرُ إلى الإنسانية التي يكون مصدرها القانون. ب- عدم مصداقية تقرير منظمة هيومن رايتس ووتش في معظم التّهم للواقع القطري؛ حيث اتهمت ووجهت الشُّبُهات إلى حقوق المرأة في دولة قطر، ولكن معظم الشُّبُهات غير صحيحة، مثال عليها: جلسة التحكيم بين الزوجين تأخذ الكثير من الوقت، وفي الواقع القطري لا تتجاوز ستة أشهر. |

| Alternative Abstract | The primary objective of this study is to critically assess the Human Rights Watch report concerning women's rights in Qatar through the lens of Islamic jurisprudence. The study aims to emphasize the fundamental principle of equality between men and women in terms of rights and responsibilities under Islamic law while also debunking any unfounded allegations or doubts about women's rights in Qatar. To achieve this goal, the study employed analytical and comparative. The researcher has obtained several key findings, among which the most significant are: A-The source of rights in Islamic Sharia law is due to Allah, which is based on humanity. As for human rights organizations, the basis of their rights is to look at humanity, whose source is the law. B- The researcher found that the Human Rights Watch report lacks credibility in its allegations against the Qatari reality, particularly with regards to women's rights. While the report raised suspicions and accusations regarding women's rights in Qatar, most of these allegations are unfounded. For instance, the report suggested that arbitration sessions between spouses take an excessive amount of time, whereas in reality, these sessions do not exceed six months in Qatar. |
