| Abstract | يتناول البحث عقود الأمانات في الفقه الإسلامي "عقد الحراسة أنموذجاً"، حيث يتركز الموضوع على الحراسات التي بها تحفظ الحقوق من التعدي عليها، وبما أن المسؤولية قائمة على وضع الأشياء تحت الحراسة فإنني قد قمت بدراسة وتحليل مفهوم عقود الأمانات، وأهمية الحراسة في الحياة للناس عموماً وتنظيم المرافق سواء كانت عامة أو خاصة أو أشخاص مهمين على وجه الخصوص، وتبرز هذه الأهمية عند الحاجة الملحة إليها في هذا الزمن. وأصول هذه الحراسة وحفظ الأمن كانت موجودة لدى المسلمين فقد عرفت المجتمعات حراسة المرافق والأسواق والشخصيات منذ عهد الرسول ﷺ وعهد الصحابة رضي الله عنهم والسلف. وعقد الحراسة الأمنية هو توافق إرادة الأطراف لإحداث أثر قانوني هو حماية المعقود عليه، وهذا العقد (عقد الحراسة الأمنية ) كغيرة من العقود له أركان يقوم عليها، وهو من قبيل الإجارة الخاصة عند الفقهاء وهي الإجارة على أداء الأعمال؛ ولذا حرص الفقه الإسلامي والنظام السعودي على رفع مستوى العامل (الحارس) سواء من الناحية الاقتصادية أو الاجتماعية أو الثقافية أو الصحية، ووضع شروطا لمن يتولى إدارة الحراسة. |

| Alternative Abstract | The research covers trust deeds in Islamic jurisprudence, “custody contract as a model”. This topic focuses on the custody by which rights are preserved from being violated. Since responsibility is based on placing things under custody, I have studied and analyzed the concept of trust deeds, and the importance of custody in people’s lives in general, along with organizing practices, whether public or private, or individuals of special importance in particular – such importance emerges when these aspects are urgently needed at this time. The principles on which this type of custody and maintaining security existed among Muslims over ages. Societies had known the guarding of facilities, markets, and personalities since the era of Prophet Mohammad (PBUH), and the era of His Companions, may God be pleased with them, and other predecessors. The custody deed for maintaining security is an agreement that reflects the will of all parties to create a legal effect, namely, to protect the subject of the contract. This contract (the custody deed for maintaining security), like other contracts, is based on certain pillars. It is like a special employment according to jurists, which is a hiring to perform a certain work. Therefore, Islamic jurisprudence and the Saudi system have been keen to improve the employment conditions (worker), whether economically, socially, culturally or health-wise, and set conditions for whoever manages such a custody. |
