| الملخص | كان الإمام الشافعي رحمه الله تعالى شديد التمسك بالسنة النبوية والدعوة إليها والدفاع عنها، وكان من منهجه في استنباط الأحكام من السنة أنه كان يرى صحةَ الحديث كافيةً للعمل به، وبناء على ذلك كانت له مناقشات مع مَن اشترط شروطاً إضافيةً للعمل بالحديث الثابت. ومع كون الشافعي معروفاً بأنه يوجب العمل بالحديث بمجرد ثبوته، إلا أنه أورد في كتبه عدداً من الأحاديث التي خالفها ولم يعمل بها. فيأتي هذا البحث لمناقشة هذه المشكلة، ومحاولة معالجة قضية سبب عدول الشافعي عن العمل ببعض ما رواه من الأحاديث. وقد قام الباحث باستقراء الأحاديث التي خالفها الشافعي في أبواب العبادات من كتابه (الأم)، ودراسة تلك الأحاديث، وتحليل كلام الشافعي حولها حين يُبيِّن علةَ تركِهِ العملَ بذلك الحديث، ثم قام باستنباط منهج الشافعي في التعامل مع السنن، وشروطه في قبولها، وأسباب تركه للعملِ ببعضها. |

| الملخص البديل | The hadiths that Imam Shafii does not accept in his book “Al-Umm” in the chapters of worships Imam Shafii was strict with holding the Sunnah of the Prophet Muhammad Peace be Upon Him and calling to it and defending it, and his way of giving a ruling from the Sunnah that he was accepting the Sound hadith enough to use it as a proof. In addition to this, he was discussing with who added some additional conditions for Sound hadith to use it as a proof. Despite of Shafii is famous with that using the Sound hadith as an evidence for him wajib, but he mentioned in his book from these Sound hadiths that opposed to them and not used them as a proof. The problem of this research is to solve the issue of giving up the Shafii from these hadiths to use them a proof. The researcher had analyzed the hadiths that Shafii opposed them in chapters of worships in his book “Al-Umm”, and studied these hadiths, and examining the sayings of Shafii when he shows the problem around his giving up these hadiths for not using them as rule, after examining his saying through his opposing to these hadiths. The researcher investigated the way of Shafii in dealing with Sunan, and the conditions of accepting them, and the reasons of not using them as a proof. |
