مدى استقلال الاتحادات الرياضية الوطنية : دراسة مقارنة في القانونين القطري والفرنسي

| Abstract | يتمثل الهدف من هذا البحث في بيان حدود استقلال الاتحادات الرياضية الوطنية على المستويين الداخلي والخارجي: حيث يطرح هذا الاستقلال على المستوى الداخلي في مواجهة الدولة خصوصا، وعلى المستوى الخارجي في مواجهة الاتحادات الرياضية الدولية، وتم اتباع المنهج التحليلي الوصفي المقارن في هذا البحث، وقد تم التوصل فيه إلى جملة من النتائج أبرزها: الطبيعة النسبية لاستقلال الاتحادات الرياضية الوطنية في مواجهة الدولة؛ حيث تمارس الدولة أنماطا متعددة من الرقابة على عمل هذه الاتحادات في كل من فرنسا وقطر، وهو أمر طبيعي حيث وضعت الرياضة في كلتا الدولتين في إطار المرفق العام: مما تطلب تمويلا للنشاط الرياضي من المال العام، كما أنه لا يوجد استقلال للاتحادات الرياضية الوطنية في مواجهة الاتحادات الدولية، بل العلاقة بينهما هي علاقة تبعية، ولعل أهم مظاهر التبعية هي التبيعة القاعدية حيث تلتزم الاتحادات الوطنية بالخضوع إلى القواعد التي تضعها الاتحادات الدولية، وذلك مع ضرورة مراعاة النظام القانوني السائد في الدولة التي تعمل ضمنها هذه الاتحادات الوطنية. كما تم التوصل إلى مجموعة من التوصيات أهمها: إيجاد إطار قانوني واضح للإشراف الذي تمارسه الدولة على الاتحادات الرياضية في دولة قطر من خلال وزارة الرياضة والشباب مع ضرورة تبني اتفاق الأهداف بين الاتحادات والدولة، من أجل حوكمة المساعدات المالية المقدمة للاتحادات الرياضية من المال العام، وجعل الرقابة عليها أكثر سهولة وشفافية. وضرورة وجود نص تشريعي واضح ينص على وجود علاقة عقدية بين الاتحادات الرياضية القطرية وأعضائها؛ مما يسهل من نقل القواعد التي تضعها الاتحادات الرياضية الدولية وطبعها بالطابع الإلزامي في مواجهة هؤلاء الأعضاء، وذلك مع مراعاة مسائل النظام العام في دولة قطر. |

| Alternative Abstract | The aim of this research is to show the limits of the independence of national sports federations, at both the internal and external levels, where this independence is presented at the internal level in the face of the state specifically, and in the face of international sports federations at the external level. A comparative descriptive analytical approach was adopted in this research, and a set of results were derived. Most notably, the relative nature of the independence of national sports federations in the face of the state, where the state exercises multiple types of control over the operation of these federations in both France and Qatar which is normal, as sports in both countries were placed under the public utility, which required funding for sports activity from public money. Furthermore, the is no independence for national sports federations in the face of international federations, but the relationship is rather a dependent relationship, and perhaps the most important manifestation of dependence is the normative power, where the national federations are obligated to submit to the rules set by the international federations, along with the need to consider the prevailing legal system in the country within which these national federations operate. A set of proposals was also reached, the most important of which is the creation of a clear legal framework for the supervision exercised by the state over the sports federations in the State of Qatar through the Ministry of Sports and Youth, with the need to adopt agreement of purposes between the federations and the state. This is to govern the financial aid provided to sports federations from public money, and to make control over it easier and more transparent. Additionally, there is the need for a clear legislative text stipulating the existence of a contractual relationship between the Qatari sports federations and their members, which facilitates the transfer of the rules set by the international sports federations and making them of a mandatory nature in the face of these members, while taking into account issues of public order in the State of Qatar. |
