| Abstract | يتناول هذا البحث مفهوم كلي القوامة في الإسلام باعتباره قضية محورية في الأسرة في ظل التحولات الاجتماعية الحديثة. ويهدف إلى تقديم دراسة معمقة شاملة لمفهوم القوامة من خلال تحليل جذوره اللغوية والشرعية وتفسيراته عند العلماء، وبيان الأدلة الشرعية الموصلة المبدأ القوامة في ضوء مقاصد الشريعة والقواعد الفقهية والضوابط الدقيقة، وتنزيل ذلك على نماذج من النوازل المعاصرة المواجهة التحديات الحديثة والتغيرات الاجتماعية. وقد اعتمد الباحث على المنهج الوصفي لدراسة مفردات القوامة، والمنهج التحليلي لربط جزئياتها وتحليل عللها وربطها بالمقاصد والقواعد الكلية والمنهج الاستقرائي لاستخلاص الضوابط الشرعية من الفروع الفقهية. وقد تعرض الباحث الجوانب مختلفة في كلي القوامة "تأصيلا وتنزيلا" حتى ينتظم البعدين التشريفي والتكليفي للقوامة، ويحقق التوازن بين الحقوق والواجبات داخل الأسرة، وتطبيق ذلك في جملة من المسائل المعاصرة. وخلص البحث إلى أن كلي القوامة في الإسلام يجمع للرجل بين التشريف الفطري والتكليف الوظيفي في قيادة الأسرة وفق أصول الشريعة بما يحقق العدل والمصلحة وأن القوامة في جوهرها تكليف ومسؤولية تهدف إلى خدمة المرأة وحفظ حقوقها، مع تعزيز دورها المحوري في الأسرة، دون إلغاء لشخصيتها أو انتقاص من كرامتها. وأوصى الباحث بتعزيز التطبيقات المعاصرة للقوامة المواكبة التحولات الاجتماعية، مع الحفاظ على الأصول الشرعية والمقاصد الكلية التي تحقق الاستقرار الأسري، والتكامل الوظيفي بين الزوجين. |

| Alternative Abstract | This research addresses the concept of "Total Guardianship" (Kulliyat alQawama) in Islam as a pivotal issue within the family amidst modern social transformations. It aims to present a comprehensive, in-depth study of the concept of guardianship by analyzing its linguistic and legal roots and its interpretations among scholars. The study elucidates the legal evidences that establish the principle of guardianship in light of the objectives of Sharia (Maqasid al-Sharia), jurisprudential rules, and precise regulations. It applies these findings to examples of contemporary issues to confront modern challenges and social changes. The researcher has relied on the descriptive method to study the terms related to guardianship, the analytical method to connect its components, analyze its reasons, and link it to the objectives and general rules, and the inductive method to extract legal regulations from jurisprudential branches. The researcher explores different aspects of "Total Guardianship" in both "foundation and application" to encompass both the honorific and obligatory dimensions of guardianship, achieve a balance between rights and duties within the family, and apply this to a number of contemporary issues. The research concluded that "Total Guardianship" in Islam combines for the man both innate honor and functional obligation in leading the family according to the principles of Sharia, achieving justice and benefit. Guardianship, in its essence, is an obligation and responsibility aimed at serving the woman and preserving her rights, while enhancing her pivotal role in the family without negating her personality or diminishing her dignity. The researcher recommended enhancing contemporary applications of guardianship to keep pace with social transformations, while preserving the legal foundations and general objectives that achieve family stability and functional integration between spouses |
