| Abstract | يعدُّ مفهوم الميراث الرقمي من المفاهيم والمصطلحات الحديثة بات يعرف على أنه مصطلح قانوني جديد أصبح منتشرا في الكثير من النظم القانونية حول العالم. وبدأت فكرة الميراث الرقمي في الظهور والتبلور في بداية القرن الواحد والعشرين وانطلقت بقضية الجندي الأمريكي كوبرارل إلسورث وتتمثل الأفكار الرئيسة للميراث الرقمي في بيان الموقف القانوني .(Corporal Ellsworth) للمحتوى والممتلكات والموجودات الرقمية، وفي إمكانيةِ توريثها ونقل ملكيتها للورثة، أو للموصى لهم، وأيضا للخلف العام للمتوفَّى. وما يعارضُ فكرة الميراث الرقمي من حق الإنسان في الخصوصية، وحقَّهِ في أن يُنسى بعد موتهِ أو إبَّان حياتهِ، وهي من المسائل الجوهرية نظرا لاحتواء الميراث الرقمي على معلومات وبيانات وموجودات رقميَّة خاصة. كما لا يمكنُ إغفالُ الدور الذي من الممكن أن تؤديه الحسابات الوهمية ومدى تأثيرها على الميراث الرقمي. |

| Alternative Abstract | Digital Assets and Accounts between inheritance and termination Digital inheritance is a modern concept and terminology known as a new legal term prevalent in many legal systems around the world. The idea of digital inheritance emerged at the beginning of the twenty-first century, it started with the case of the American soldier Corporal Ellsworth. its main idea is to define the legal position of the content, property and digital assets, and the possibility of inheriting them and transferring their ownership to heirs, or to their devisee, and to the general successor of the deceased. Digital inheritance contradicts with human right to privacy, and the right to be forgotten after his/her death or during his/her life, which are fundamental issues since digital inheritance contains private digital information, data, and assets. Fakes accounts can negatively impact the digital inheritance. Therefore, this issue cannot be ignored. |
