| Abstract | نظراً لأهمية موضوع الدمج الاجتماعي لذوي الإعاقة؛ دعت الحاجة إلى دراسة الأحكام الفقهية المترتبة على مقصد الدمج الاجتماعي لذوي الإعاقة في أحكام المعاملات، مثل: أحكام عقود المعاوضات، وعقود التوثيق، وعقود التبرعات وغيرها، بالإضافة إلى بيان أحكام الأحوال الشخصية كأحكام انعقاد النكاح، وانحلاله، والحضانة وغيرها، وذلك بغية استجلاء مقص د الدمج الاجتماعي، والغايات من هذه الأحكام الفقهية من جهة، وربطها بالدراسات النفسية، والاجتماعية الحديثة المهتمة بقضية الدمج الاجتماعي لذوي الإعاقة من جهة أخرى. وتتمثل إشكالية الدراسة في الحاجة للكشف عن مدى توافق الأحكام الفقهية في الدمج الاجتماعي لذوي الإعاقة، مع مقاصد الشريعة وغاياتها الكبرى، وقد سلكت الباحثة في دراستها كلًا من المنهج التاريخي، والمنهج الاستقرائي التحليلي، والمنهج الوصفي المقارن، وتوصلت إلى جملة من النتائج من أهمها: أن الشريعة الإسلامية اعتنت بدمج الأشخاص ذوي الإعاقة اجتماعيًا، وبذلك فقد سبقت النظريات الحديثة في التطرق للدمج الاجتماعي، وأن الشريعة الإسلامية أجازت كثيراً من العقود التي يجريها ذوو الإعاقة في باب المعاملات، والأحوال الشخصية، كما أن لهذه الأحكام الفقهية المتعلقة بذوي الإعاقة مقاصد شرعية تصب في تحقيق مقصد الدمج الاجتماعي . |

| Alternative Abstract | In view of the importance of social integration of the people with special needs, it is inevitable to study the legal rules regulating the subject in the area of law of transactions. These include contracts of finance, documentation, donation, etc. This is in addition to legal rules concerning personal aspects of life such as marriage and its consummation, custody, and others. The main thrust of this study is to articulate the essence of social integration and goals of those legal rules on one hand. On the other hand, these legal rules shall be studied in connection with the modern psychological and social studies as they relate to the issue of social integration of the People with special needs. This is borne out of the need to know the extent at which legal rules concerning the social integration of the People with special needs conform to the sublime goals and objectives of the Shari’ah. The researcher has employed historical, inductive, analytical, descriptive, and comparative methods to carry out this research. One of the major findings of the research is that the Islamic law places a high premium on the social integration of the people with special needs and predates various modern theories on the subject. Also, the Islamic law permits the physically challenged persons to engage in many contracts in the realms of financial transactions and personal status. More importantly, all the legal rules of the Islamic law regarding people with special needs have a fundamental goal which is the promotion of social integration. |
