| Abstract | هذا البحث وعنوانه:(حكم تضمين سيارات الأجرة في الفقه الإسلامي)، الذي سلك فيه الباحث المنهج الوصفي المقارن، هدف للتعرف على مفهوم تضمين سيارات الأجرة كما يحدث في السوق، مع بيان صوره وأشكاله، وتوصل إلى أن التكييف الفقهي للعلاقة التعاقدية بين المالك صاحب المركبة والسائق إما أن تكون عقد على إجارة أشخاص أو أعيان، وهذا جائز باتفاق المذاهب، وإما عقد مضاربة،وهذا في العروض جائز عند الحنابلة في قول خلافا لغيرهم، ويوصي الباحث بأهمية فهم العلاقة التعاقدية الناشئة بين الطرفين، وما يترتب عليها من أحكام والتزامات. |

| Alternative Abstract | This paper, titled “The Ruling of Leasing Taxicabs in Islamic Jurisprudence”, follows a descriptive- comparative methodology, and touches upon the concept of leasing taxicabs (tadmin). The paper lists the various forms of (tadmin) and describes the contractual relationship between the owner of the cab and the driver. It determines that the contract may be characterized as one of two types. It may be firstly categorized as a rental contract in which the usufruct is either specific items or people (ayan or ashkhas).This type of contract is legitimate according to all Islamic schools of jurisprudence. Alternatively, it may be categorized as a mudarabah partnership contract, which is only valid according to the Hanbali School. The researcher recommends further research regarding the contractual relationship between the two parties and the consequential rules and regulations of the contract. |
