| Abstract | إذا أراد الشفيع أن ينجح في الحصول على العقار المبيع بالشفعة فإنه يلتزم بإتباع إجراءات رسمها القانون ورتب على أي خلل فيها سقوط حق الشفيع في الأخذ بالشفعة. ويأتي في مقدمة هذه الإجراءات إعلان الشفيع رغبته في الأخذ بالشفعة. هذا الإجراء يثير عددًا من التساؤلات تتعلق بتحديد الميعاد الذي يجب على الشفيع أن يعلن رغبته فيه، والطريقة التي يجب أن تتبع في إعلان الرغبة كما يتعين بيان ما إذا كان إعلان الرغبة كافيًا لحماية الشفيع من تصرفات المشتري الواردة على العقار المشفوع فيه. وسوف نحاول من خلال هذا التعليق الإجابة عن تلك التساؤلات. |

| Alternative Abstract | If the preemptor wants to succeed in obtaining the sold preemptive property, he is obligated to follow procedures and arrangements established by law to deal with any defect that might cause the loss of the preemptor’s right to take preemption. At the forefront of these measures comes the announcement of the preemptor desire to take the preemption. This procedure raises a number of questions related to determining the time of announcement and the method that should be followed in declaring the preemptor’s desire. It also must be clarified whether the declaration of desire is sufficient to protect the preemptor from the expected actions of the buyer on the preemptive property. We will try to answer these questions in this commentary. |
